Pumuant to the California Environmental Quality Act, the City Council <br />hereby determines that the environmental impact report (EIR) prepared in <br />conjunction with the adoption of the City's Midtown Specific Plan may be <br />used for this project. This Eli:{ was both a programmatic Eli:{ and was <br />intended to be used as a tiered document. In making this determination, <br />the City has reviewed the project, including its environmental setting, its <br />impacts, adopted mitigation measures and alternatives, and finds that the <br />information in the EIR as it relates to the project is for these purposes <br />identical with the scenado presumed in the EIR for the eventual <br />development of the Site; the conditions requiring preparation of a <br />subsequent, supplement or addendum to the Ell:{ are not present in this <br />case. The Midtown Specific Plan EtR is hereby determined to be adequate <br />for and is certified for this project. A notice of determination shall be filed by <br />staff. <br /> <br />Pursuant to the provisions of the California Redevelopment Law, the <br />Agency and the City Council have held a duly noticed joint public headng <br />on the proposed sale of the Site pursuant to the Agreement. <br /> <br /> Section 2. The City Council has considered all terms and conditions of the <br />proposed sale and hereby finds and determines that the sale and the redevelopment of <br />the Site pursuant to the Agreement is the best interests of the City of Santa Ana and the <br />health, safety and welfare of its residents, and is in accord with the public purpose and <br />provisions of the applicable state and local laws. <br /> <br /> Section 3. The City Council hereby finds and determines that the consideration <br />for the sale of the Site pursuant to the Disposition and Development Agreement is not <br />less than the fair reuse value of the Site determined in accordance with the covenants <br />and conditions goveming the sale. <br /> <br /> Section 4. The sale of the Site by the Agency to Sycamore Parking Concepts, <br />Inc., upon the terms and conditions contained in the Agreement is hereby approved. <br /> <br /> Section 5. The City Manager authorized to execute the necessary documents <br />with the Community Redevelopment Agency to transfer to the Agency title to the YMCA <br />building, includin~ the property to be transferred pursuant to the Agreement. The City <br />Manager is further authorized to negotiate and execute a sublease agreement for the 150 <br />parking spaces in this parking garage from the Community Redevelopment Agency on a <br />month-to-month basis subject to approval as to form by the City Attorney. <br /> <br /> Section 6. <br />this Resolution. <br /> <br />The Clerk of the Council shall attest to and certify the vote adopting <br /> <br />ADOPTED this 16th day of December, 2002. <br /> <br />Resolution No. 2002-110 <br />Page 2 of 3 <br /> <br /> <br />
