Inc., a California corporation ("Consultant") and the City of Santa Ana, a charter city and <br />municipal corporation of the State of California ("City"). <br /> <br />. <br /> <br />. <br /> <br />A-2003-013 <br /> <br />FIRST AMENDMENT TO <br />CONSULTANT AGREEMENT <br /> <br />Recitals: <br /> <br />A. The parties entered into Agreement No. N-2002-122, dated August 12,2002, <br />(hereinafter "said Agreement") by which Consultant has provided industrial hygiene <br />testing. <br /> <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />amend the Scope of Services provided by Consultant and increase the compensation <br />available for the additional services. <br /> <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this First <br />Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />1. Paragraph 1, SCOPE OF SERVICES, shall be amended to read in full as follows: <br /> <br />"Consultant shall perform an indoor air quality investigation of the animal care <br />shelter as detailed in Exhibit A, attached to said Agreement. <br /> <br />Additionally, Consultant shall provide on call services including investigations of <br />industrial safety engineering, indoor air quality, noise assessment and control, <br />industrial ventilation, asbestos and lead identification, health and safety training, <br />environmental air monitoring and regulatory compliance of various City agencies, as <br />requested by the City Risk Manager." <br /> <br />2. Paragraph 2 a, COMPENSATION, shall be amended to read as follows: <br /> <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />the rates and charges identified in Exhibit A for the air quality study and the <br />following rates for on-call services: <br /> <br />Expert field, preparation and research time <br />Expert deposition and court testimony <br />Senior Industrial Hygienist <br />Industrial Hygienist <br />Word Processor <br />Mileage <br /> <br />$350.00 per hour <br />450.00 per hour <br />175.00 per hour <br />125.00 per hour <br />40.00 per hour <br />.40 per mile <br />
