RFP 01-042 <br /> <br />STANDARD TERMS AND CONDITIONS <br /> <br />PROPOSAL SUBMISSIONS <br />Proposals must be submitted to Purchasing Office in a sealed envelope showing on the <br />outside, the name of the bidder, RFP NO. 01-042, and date & time due. All proposals <br />must be signed by an authorized representative of the Offeror. <br /> <br />PROPOSAL WITHDRAWAL <br />Proposals may be withdrawn by written request received before the hour set for the <br />opening. <br /> <br />LATE PROPOSALS <br />It is the responsibility of the offeror to see that any proposal submitted shall have <br />sufficient time to be received by the Purchasing Office prior to proposal due date and <br />time. Late proposals will be returned to the offeror unopened. <br /> <br />REQUIRED DOCUMENTS <br />Offerors must submit 1 ORIGINAL and 3 photocopies of each Proposal offered. <br /> <br />10. <br /> <br />11. <br /> <br />RIGHTS RESERVED <br />The right is reserved by the City of Santa Ana to reject any or all proposals or to waive <br />any informality or technical defect in a proposal. <br /> <br />CONTRACT <br />Offeror's signed proposal and written acceptance by the City shall constitute a contract. <br /> <br />OFFEROR AGREEMENT <br />Submission of a signed proposal without deviations will be interpreted to mean that <br />offeror has agreed to all the terms and conditions set forth in all of the sheets which make <br />up this Request For Proposal. Any deviations noted by the offeror may be rejected by the <br />CID'. <br /> <br />SELL OR ASSIGN <br />The successful offeror shall not have the right to sell, assign, or transfer any obligations <br />resulting from this proposal without the specific written consent of the City. <br /> <br />ACCEPTANCE OF THE OFFER <br />Acceptance of the offer shall be limited to the terms herein unless expressly agreed in <br />writing by the City. <br /> <br />CANCELLATION <br />The City WITHOUT CAUSE may cancel this agreement at any time upon thirty (30) <br />days written notice to the supplier. <br /> <br />This agreement may be canceled at any time WITH CAUSE within ten (10) days written <br />notice to the supplier. Cancellation for cause shall be at the discretion of the City and <br />shall be, but is not limited to, failure to meet the minimum requirements within the time <br />specified or within the terms, conditions and provisions of this proposal. <br /> <br />LOCAL SALES TAX CONSIDERATION <br />In accordance with the Santa Ana code, a 1% preference will be applied to all proposals <br />for taxable goods submitted by suppliers located within the City limits of Santa Ana. <br /> <br />3 <br /> <br /> <br />
