AMENDMENT TO AGREEMENT <br /> <br />A-2003-130 <br /> <br /> THIS AMENDMENT, is made and entered into this 17m day of June, 2003, by and between W. Koo & <br />Associates ("Consultant") and the City of Santa Ana, a charter city and municipal corporation of the State of <br />California ("City"). <br /> RECITALS <br /> <br /> A. The Parties entered into that certain agreement entitled "Consultant Agreement" dated December 7, 1998, <br />hereinafter referred to as "said Agreement", for providing structural plans, specifications and estimates for the <br />seismic retrofit design of three City owned bridges; <br /> <br /> B. Consultant was awarded the contract after submitting its proposal in response to the City's Request for <br />Proposals. The consultant selection process was performed in compliance with the Local Assistance Procedures <br />Manual and the pre-audit of Consultant has been met. <br /> <br /> C. The Parties hereto now desire to amend the Scope of Work contained in said Agreement in order to <br />supplement the work to be performed by adding one additional bridge, as well as adding environmental compliance <br />services for the four (4) bridges in the Santa Ana River Bridge Project. The Compensation section will also be <br />amended to compensate the additional work. <br /> <br /> WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter contained and <br />made, and subject to all of the terms and conditions of said Agreement as hereby amended, the parties hereto do <br />hereby agree as follows: <br /> <br /> 1. The "Scope of Services" section of said Agreement (Section 2.) is hereby supplemented by adding the <br />seismic retrofitting of the Fairview Street Bridge, as well as adding environmental consulting services for all four <br />bridges in accordance with the supplemental Exhibit Al attached hereto and incorporated herein by reference. <br /> <br /> 2. The "Compensation" section of said Agreement (Section 6.) is hereby amended to add an additional One <br />Hundred Seventy Three Thousand Seven Hundred Sixty Dollars ($173,760.00) for said supplemental work. <br /> <br /> 3. Except as hereinabove modified, the terms and conditions of said Agreement remain unchanged and in full <br />force and effect. <br /> <br />IN WITNESS WHEREOF, the parties hereto have executed this Amendment to said Agreement the date and <br /> <br />year first above written. <br /> <br />Patricia E.
