<br />. <br /> <br />. <br /> <br />by CONTRACTOR and is prepared for collection in a manner prescribed <br />by the CITY'S regulations covering the same. Under no <br />circumstances shall CONTRACTOR be required to pick up and collect <br />any material or matter which is not Solid Waste as defined in this <br />Agreement, or to pick up and collect any Solid Waste from Curbside <br />Service units which does not comply with the following standards <br />and limitations: <br /> <br />(1) All Solid Waste shall be placed in the Solid Waste <br />collection and Recycling plastic carts provided by CONTRACTOR to <br />each Curbside Service unit pursuant to the following: <br /> <br />(a) Non-Recyclable Solid Waste shall be placed in <br />burgundy plastic carts provided by CONTRACTOR; <br />(b) Recyclable Solid Waste shall be placed in grey <br />plastic carts provided by CONTRACTOR; and, <br />(c) Yard Waste shall be placed in green plastic <br />carts provided by CONTRACTOR. <br /> <br />(2) All non-Recyclable Solid Waste, Recyclable Solid <br />Waste and Yard Waste shall be placed in the appropriate Solid Waste <br />collection and Recycling plastic carts adequate to eliminate <br />overflow or contamination of surrounding areas. Any non-Recyclable <br />Solid Waste, Recyclable Solid Waste and/or Yard Waste which is not <br />placed in a Solid Waste plastic cart which has been provided to the <br />Curbside Service unit will not be picked up; and, <br /> <br />(3) Large, heavy items, including, without limitation, <br />water heaters, couches, tables, refrigerators, stoves, and large <br />pieces of furniture or household equipment shall be considered <br />bulky items which may be disposed of under the provisions of <br />section 21. <br /> <br />(b) The aforementioned requirements to place non-Recyclable <br />Solid Waste, Recyclable Solid Waste and Yard Waste in appropriate <br />Solid Waste collection and Recycling plastic carts shall not apply <br />to Christmas trees properly placed for collection. <br /> <br />(c) Whenever any Solid Waste which does not comply with the <br />above standards and limitations is not collected by CONTRACTOR, <br />CONTRACTOR shall leave a notice, the format of which is subject to <br />the approval of the CITY, indicating the reason for non-collection <br />at such Curbside Service Unit. said notice shall also contain the <br />CONTRACTOR's business name and his local telephone number. A copy <br />of said notice shall be delivered, or sent via telephone facsimile, <br />to the CITY upon request by the Executive Director and, if the <br />reason for noncollection is not corrected within seven (7) days, <br />CONTRACTOR shall notify the CITY as to this continued <br />noncollection. <br /> <br />12 <br />
