<br />. <br /> <br />. <br /> <br />CONTRACTOR, whether such equipment and vehicles are owned by or <br />licensed to CONTRACTOR pursuant to section 11 herein, with Solid <br />Waste from any other jurisdiction or person from outside the CITY <br />limits; however, in the event of an emergency vehicle breakdown, a <br />vehicle from a neighboring jurisdiction may complete the route of <br />the vehicle which broke down. In this case, the CONTRACTOR must <br />notify the CITY in writing within twenty four (24) hours of such <br />emergency breakdown and must also provide the CITY with the <br />allocation of tonnages contained in the vehicle. <br /> <br />5. <br /> <br />COLLECTION HOURS: <br /> <br />(a) All collections from residential areas shall be made <br />between the hours of 6:00 a.m. and 6:00 p.m. Collections from <br />commercial and industrial locations greater than 100 feet from <br />residential units may start at 3:00 a.m. and must terminate by 9:00 <br />p.m.; however, if complaints are received from such residential <br />units, the Executive Director may direct that collections in such <br />areas shall be made between the hours of 6:00 a.m. and 6:00 p.m. <br />and in that event CONTRACTOR agrees to comply with such order. <br /> <br />(b) Notwithstanding section (a) above, Solid Waste collected <br />pursuant to section 13 hereof shall be collected pursuant to the <br />provisions contained therein. <br /> <br />6. <br /> <br />HOLIDAYS: <br /> <br />Where, on a given route, the day of collection would be a <br />legal holiday, CONTRACTOR shall collect along said route on the <br />work day next following said legal holiday and collection on each <br />day during said holiday week shall be similarly delayed one day. <br />Legal holidays for the purpose of this Agreement shall be New <br />Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving <br />Day, Christmas Day and such other days as may be mutually agreed <br />upon in advance by the parties. <br /> <br />7. <br /> <br />FREOUENCY OF COLLECTIONS: <br /> <br />The Contractor will collect all Solid Waste from all areas of <br />the CITY at least once each week and in addition will provide more <br />frequent service for those Customers using the Bin Services or <br />Roll-Off Services supplied by CONTRACTOR if requested by a Customer <br />or if required by the CITY. <br /> <br />8. <br /> <br />MAINTENANCE OF SCHEDULES: <br /> <br />Presently existing routes, schedules and times for collection <br />of Solid Waste shall be maintained but may be changed by <br />authorization of the Executive Director and at least one week's <br />advance notification by CONTRACTOR to occupants of the buildings in <br />the area where the changes are to be made. <br /> <br />7 <br />
