RESOLUTION NO. 2003-057 <br /> <br />A RESOLUTION ESTABLISHING POLICIES AND <br />PROCEDURES FOR CITY PARTICIPATION IN AMICUS <br />CURIAE LEGAL BRIEFS. <br /> <br />JWF(5/22/03) <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br /> Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />A. From time to time the City of Santa Ana is requested by other public agencies, <br /> the League of California Cities or other municipal organizations to participate in <br /> "amicus curiae" or friend of the court briefs in pending litigation of importance to <br /> local government; and, <br /> <br />B. It would be expedient to authorize the City Attorney and City Manager to <br /> determine whether or not to authorize such participation without formal action in <br /> advance by the City Council. <br /> <br /> Section 2. The City Attorney, following consultation with the City Manager, is <br />hereby authorized to approve the participation of the City of Santa Ana as an amicus <br />curiae upon the request. Prior to giving final approval, the City Attorney shall notify the City <br />Council in writing of the intended participation with the basis for the action. Upon the <br />request of any one Councilmember following receipt of such notice, the City Attorney shall <br />agendize the matter for Council action. If time does not permit to do so, the City Attorney <br />shall withhold amicus participation. <br /> <br /> Section 3. This Resolution shall take effect immediately upon its adoption by <br />the City Council, and the Clerk of the Council shall attest to and certify the vote adopting <br />this Resolution. <br /> <br />ADOPTED this 16th day of June, 2003. <br /> <br />Resolution No. 2003-057 <br /> Page 1 of 2 <br /> <br /> <br />
