INSURANCE ON FILE <br />WORK MAY PROCEED <br />UNTIL INSURANCE PIRES <br />CLEIIK,OF O�NCIL' <br />CAtEI (a �ir o 3 <br />AMENDMENT TO <br />CONSULTANT AGREEMENT <br />c5A <br />THIS AMENDMENT TO CONSULTANT AGREEMENT, # A-2003-080, is <br />entered into this --?--day of 2003, by and between Scott H. Weldy, DVM, <br />a sole proprietor ("Consultant") and theCity of Santa Ana, a charter city and municipal <br />corporation of the State of California ("City"). <br />Recitals: <br />A. The parties entered into Agreement #N2003-008, dated February 6, 2003, (hereinafter <br />"said Agreement") by which Consultant has provided veterinary services to the Santa <br />Ana City Zoo. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />extend the term of said Agreement and increase compensation to pay for services <br />during the extended term. <br />Wherefore, in consideration of the covenants contained in the Agreement, and subject to <br />all the terms and conditions of said Agreement, except those amended in this First <br />Amendment to Consultant Agreement, the parties agree as follows: <br />1. Section 2.a., COMPENSATION, shall be amended to read as follows: <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services <br />the rates and charges identified in Exhibit A. Maximum amount for reimbursable <br />expenses shall be $2,000.00 per fiscal year. The total sum to be expended for <br />services and reimbursable expenses under this Agreement, shall not exceed <br />$20,000.00 during the term of this Agreement." <br />2. Section 3, TERM, shall be amended to read as follows: <br />"This Agreement shall commence on February 6, 2003 and terminate on June 30, <br />2004, unless terminated earlier in accordance with Section 12, below. The term of <br />this Agreement may be extended upon a writing executed by the Executive Director <br />of the Parks, Recreation and Community Services Agency and the City Attorney." <br />3. The first paragraph of Section III, COMPENSATION, of Exhibit A shall be amended <br />to read as follows: <br />"CONSULTANT agrees to perform the professional services as set forth herein and <br />CITY agrees to pay CONSULTANT for all such services at the rate of one hundred <br />dollars ($100.00) per hour. Said fees shall be paid not later than 30 days after receipt <br />of proper invoice evidencing work performed, subject to CITY accounting <br />
