INSURANCE ON FILL WORK MAY PROCEED UNTIL INSURANCE F. XPIRF, S 'CLERK OF. COUNCIL DATE: SECOND AMENDMENT TO CONSULTANT AGREEMENT THIS SECOND AMENDMENT TO CONSULTANT AGREEMENT, is entered into on this "2-~ ~ day of ~' r.~ [ ,4 ,2003, by and between Susan Atkinson, a sole proprietor ("Consultant")~tndth~ City of Santa Ana, a charter city and municipal corporation of the State of California ("City"). Recitals: mo The parties entered into Agreement #N-2002-043, dated May 9, 2002, (hereinafter "said Agreement") by which Consultant has provided Administrative Hearing services to the City' Community Preservation Department. Bo The parties entered into a First Amendment to Agreement #A-2002-222, which provides that Consultant will also provide Administrative Hearing services to the Santa Ana Police Department for Animal Services citations (hereinafter "Amendment"). C. In accordance with the terms and conditions of said Agreement and Amendment, the parties wish to extend the term of said Agreement for an additional one-year period. Wherefore, in consideration of the covenants contained in said Agreement and Amendment, and subject to all the terms and conditions of said Agreement and Amendment, except those amended in this Second Amendment to Consultant Agreement, the parties agree as follows: 1. Section 3, TERM, of said Agreement, shall be amended to read as follows: "This Agreement shall commence on May 9, 2002 and terminate on June 30, 2004, unless terminated earlier in accordance with Section 12, below. The term of this Agreement may be extended upon a writing executed by the Deputy City Manager for Development Services and the City Attorney." IN WITNESS WHEREOF, the parties hereto have executed this Second Amendment to Consultant Agreement on the date and year first written above.
