1NSURANCEPNI FILE' <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />CLERK OF COUNCIL <br />DATE: q ,q <br />SECOND AMENDMENT TO <br />CONSULTANT AGREEMENT <br />N- 2002 -112 <br />C' TP <br />• THIS SECOND AMENDMENT TO CONSULTANT AGREEMENT, is entered <br />into on July 1, 2002, by and between Martha Lomeli (hereinafter "Consultant ") and the <br />City of Santa Ana (hereinafter "City "). <br />Recitals: <br />A. The parties entered into an Agreement dated August 24, 2000, (hereinafter "said <br />Agreement ") by which Consultant has provided counseling and instructional services <br />to inmates housed in the Santa Ana Jail. <br />B. Said Agreement was extended for one year, to June 30, 2002, by a May 30, 2001 <br />letter agreement. <br />C. Said Agreement was amended on February 28, 2002 to increase the amount of <br />compensation to $10,000 (hereinafter "First Amendment "). <br />D. In accordance with the terms and conditions of said Agreement, the parties wish to <br />renew said Agreement for an additional one year period and to increase the hourly <br />rate of compensation for services provided. <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this First <br />Amendment to Consultant Agreement, the parties agree as follows: <br />1. Paragraph 2.a. COMPENSATION, shall be amended to read as follows: <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />an hourly rate of thirty -seven dollars ($37.00) for all scheduled instructional and <br />counseling sessions. Compensation shall be increased $10,000.00 to pay for services <br />provided during the extended term of this Agreement. The total sum to be expended <br />under this Agreement, shall not exceed $20,000.00 during the term of this <br />Agreement." <br />2. Paragraph 3, TERM, shall be amended to read as follows: <br />"This Agreement shall commence on August 24, 200 and terminate on June 30, 2003, <br />unless terminated earlier in accordance with Section 12, below. The term of this <br />Agreement may be extended upon a writing executed by the Chief of Police and the <br />City Attorney." <br />3. Except as hereinabove amended, all terms and conditions of said Agreement shall <br />remain in full force and effect. <br />©3 <br />
