bk:7/28/03 <br /> <br />RESOLUTION NO. 2003-067 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA EXTENDING CONDITIONAL USE PERMIT <br />NO. 2001-20 AND VARIANCE NO. 2001-05 TO PERMIT <br />THE USE OF A SPRINGHILL SUITES HOTEL AT HUTTON <br />CENTRE <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br /> ~. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />A use permitted by a conditional use permit or variance must commence <br />within two years of the City's grant of such permits. Thereafter, any such <br />conditional use permit of vadance shall become void. However, Santa Aha <br />Municipal Code Section 41-647 provides that the City Council may extend a <br />conditional use permit and a vadance pursuant to resolution. <br /> <br />On August 6, 2001, the City Council approved Conditional Use Permit <br />No. 2001-20 and Vadance No. 2001-05 to allow the construction of a <br />96,000 square foot, 162 room hotel within Hutton Centre. Prior to taking <br />these actions, the City Council approved and adopted Mitigated Negative <br />Declaration (ER No. 2000-177)for the project. <br /> <br />Due to changes in the travel industry that occurred subsequent to this <br />approval, the permittee has delayed the construction of this hotel as it <br />analyzed its business operations. <br /> <br />Over the last few months, Nexus has held discussions with the permittee in <br />an effort to pumhase this hotel site for an alternative use. The parties have <br />recently entered into escrow on the sale of the property, but that sale has <br />not been consummated and the permittee, should the sale not go forward, <br />would still desire to construct and operate the approved hotel use on the <br />property. <br /> <br /> Se~ion2. The City Council has reviewed and considered the information <br />contained in the initial study, mitigated negative declaration and its addendum, and <br />mitigation monitoring program for Environmental Review No. 2000-177 prepared with <br />respect to this Project. It is determined that, as required pursuant to the California <br />Environmental Quality Act ("CEQA") and the State CEQA Guidelines, this mitigated <br />negative declaration with its addendum and mitigation monitoring program adequately <br />addresses the expected environmental impacts of this Project.
