unavailable during these hours from other retail <br />establishments. <br /> <br />Will the proposed use under the circumstances of the particular <br />case be detrimental to the health, safety or general welfare of <br />persons residing or working in the vicinity? <br /> <br />The circulation design and layout, which will include <br />landscaping to screen the drive-through lane, will not create <br />an adverse impact or be detrimental or injurious to the <br />overall site or neighborhood. Conditions have been <br />incorporated into the project to help minimize any adverse <br />impacts t hat t he project might generate a s the result o f its <br />after-hours operation. Conditions for the project will be <br />reviewed after ninety days, six months, one year and <br />annually thereafter to ensure that the business is in <br />compliance with conditions approved for the project. It is not <br />anticipated that the use or the proposed after-hours <br />operation of the restaurant, in conjunction with the proposed <br />conditions, will be detrimental to the health, safety or general <br />welfare of persons working in the area. <br /> <br />Will the proposed use adversely affect the present economic <br />stability or futura economic development of properties surrounding <br />the area? <br /> <br />The drive-through restaurant provides a visual upgrade and <br />new economic activity for t his a rea o f South Bristol Street. <br />The economic viability of the restaurant and the overall <br />development is increased with the addition of the proposed <br />drive-through window. During the hours proposed, the use <br />provides additional services to the community, and therefore, <br />it is anticipated that the use will enhance rather than <br />adversely affect the economic development or stability of the <br />area. The overall economic stability of the area will be <br />strengthened with commercial services in the area. <br /> <br />Will the proposed use comply with the regulations and conditions <br />specified in Chapter 41 of the Santa Aha Municipal Code for such <br />use? <br /> <br />The proposed restaurant and drive-through window <br />operation will be in compliance with all applicable provisions <br />of Chapter 41 of the Santa Ana Municipal Code and design <br />standards for such facilities. <br /> <br />Resolution No. 2003-068 <br />Page 2 of 7 <br /> <br /> <br />
