The City Attorney advised Council that after a meeting with Public Works

<br />error ha~ been ma~e.

<br />~r. Joe Long, President of Lemar Corporation, and N~. Tom Job-~ton, Attorney
<br />represent~-g L~m~ Corporation, stated that they felt an honest mistake had
<br />been' made in their hid which would be classified as a clerical error rendering
<br />their firm incapable of realizing a profit.
<br />
<br />The opinion of the City Attorney was that an honest mistake had been made in
<br />the figures and since notice was given in a timely fashion before the awarding
<br />of the bid, the Courts would sustain the bidder.
<br />
<br />On motion of Councilman Burk, seconded by Councilman Herrin and carried,
<br />Council approved the withdrawal of the Lcmar Corporation bid.
<br />
<br />On motion of Councilman NcMichael, seconded by Councilman Brooks an~ carried,
<br />Council authorized that bids for Storm Drains, Projects D-5}$ an~ D-~8 be
<br />re-advertised, with changes to be made in alternatives, opening date June 1}$,
<br />1966.
