SECOND AMENDMENT TO AGREEMENT <br /> <br />N-2002-124 <br /> <br /> THIS SECOND AMENDMENT TO ,CONSULTANT AGREEMENT "Amendment," <br />made and entered into this I -'1~ day of <d~'n~002, by and between the City of Santa Ana, <br />a charter city and municipal corporation duly organized and existing under the Constitution and <br />the laws of the State of California ("City") and Santa Ana College ("Consultant"). <br /> <br /> WITNESSETH <br /> <br />Recitals: <br /> <br /> A. City and Consultant entered into a Consultant Agreement, dated December 29, <br /> 2000, by which Consultant agreed to provide educational services to inmates housed in <br /> the Santa Ana Jail (the "Agreement"). <br /> <br />B. City and Consultant entered into an Amendment to Agreement, dated May 24, <br />2001, to extend the term and increase the amount of compensation ("First Amendment"). <br /> <br />C. The parties now desire to enter into another amendment to extend the term and <br />increase the amount of compensation. <br /> <br /> WHEREFORE, in consideration of their mutual and respective promises, and subject to <br />the terms and conditions of the Agreement as hereby amended, the parties hereby agree as <br />follows: <br /> <br />1. Section 2(a) of the Agreement is amended to read as follows: <br /> <br />"a. City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />the rates and charges identified in Exhibit A. The total sam to be expended under this <br />Agreement, shall not exceed $ 6500.00 during the term of this Agreement." <br /> <br />2. Section 3 of the Agreement is amended to read as follows: <br /> <br />"This Agreement shall commence on the date first written above and terminate on June <br />30, 2003, unless terminated earlier in accordance with Section 12, below. The term of <br />this Agreement may be extended upon a writing executed by the Chief of Police and the <br />City Attorney." <br /> <br />3. Except as hereinabove modified, the terms and conditions of the Agreement and <br />the First Amendment remain in full force and effect. <br /> <br /> <br />
