INSURANCE ON FILE WORK MAY PROCEED UNTIL INSURANCE EXPIRES CLERK OF COUNCIL DATE: 8-ad-03 FIN N° -a003 - 0a9- I FIRST AMENDMENT TO CONSULTANT AGREEMENT THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT, is entered into this day of , 2003, by and between Janet Schermer ( "Consultant ") and the City of San& Ana, a charter city and municipal corporation of the State of California ( "City "). Recitals: A. The parties entered into Agreement #N- 2003 -029, dated March 13, 2003, (hereinafter "said Agreement") by which Consultant has provided piano instruction to students living in the Santa Ana Empowerment Zone. B. In accordance with the terms and conditions of said Agreement, the parties wish to extend said Agreement for an additional four months and to increase compensation to pay for the services during the extended term. Wherefore, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of the Agreement, except those amended in this First Amendment to Consultant Agreement, the parties agree as follows: 1. Section 2 a., COMPENSATION, shall be amended to read as follows: "City agrees to pay, and Consultant agrees to accept as total payment for its services, the rates and charge of $30.00 per hour of instruction. The sum to be expended under this Agreement, shall be increased by $2,000.00 for a total amount not to exceed $12,000.00 during the tern of this Agreement." 2. Section 3, TERM, shall be amended to read as follows: "This Agreement shall commence on March 13, 2003 and tenninate on October 31, 2003, unless terminated earlier in accordance with Section 12, below. The term of this Agreement may be extended upon a writing executed by the Executive Director of the Parks, Recreation and Community Services Agency and the City Attorney."
