INSURANCE ON FILE <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />CLERK OF COUNCIL <br />DATE: 8-ad-03 <br />FIN <br />N° -a003 - 0a9- I <br />FIRST AMENDMENT TO <br />CONSULTANT AGREEMENT <br />THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT, is entered <br />into this day of , 2003, by and between Janet Schermer <br />( "Consultant ") and the City of San& Ana, a charter city and municipal corporation of the <br />State of California ( "City "). <br />Recitals: <br />A. The parties entered into Agreement #N- 2003 -029, dated March 13, 2003, (hereinafter <br />"said Agreement") by which Consultant has provided piano instruction to students <br />living in the Santa Ana Empowerment Zone. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />extend said Agreement for an additional four months and to increase compensation to <br />pay for the services during the extended term. <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of the Agreement, except those amended in this First <br />Amendment to Consultant Agreement, the parties agree as follows: <br />1. Section 2 a., COMPENSATION, shall be amended to read as follows: <br />"City agrees to pay, and Consultant agrees to accept as total payment for its <br />services, the rates and charge of $30.00 per hour of instruction. The sum to be expended <br />under this Agreement, shall be increased by $2,000.00 for a total amount not to exceed <br />$12,000.00 during the tern of this Agreement." <br />2. Section 3, TERM, shall be amended to read as follows: <br />"This Agreement shall commence on March 13, 2003 and tenninate on October <br />31, 2003, unless terminated earlier in accordance with Section 12, below. The term of <br />this Agreement may be extended upon a writing executed by the Executive Director of <br />the Parks, Recreation and Community Services Agency and the City Attorney." <br />
