APPEAL 194 - VA 67-63 At the September 5th Council meeting, the EARCHER hearing was closed on Appeal 194, filed by Carl Karcher Enterprises, Inco from the Planning C~amis$ion~s denial of Variamce 67m63 to construct restauramt in R 1 District at the southwest corner of 17th and Linwoodo The mat~er was continued to give Mr. Karcher an opportunity to submit different exterior an~ interior desig~So Mr. Karcher presented plot plan and artist rendering showing new design of the building and explained that the building would now face 17th Street~ would have one additional parking stall, making 23 parking stalls, and the interior would have 12 tables, seating 54. Mayor NcMichael spoke in opposition on the basis of lmcompatibility with neighborhood and lack of 2 lots suggested by planning Ccmmuission stu~lyo Don Christeson stated there was no har~lship, as required by the Municipal Co~e, and there are 1~2 uses for the property, all of which fall within C ~ zoning. Declared out of or,er, it was moved by Councilman Griset to reopen the hearimg but there was no second. It was moved by Councilman Carlson, seco~ed by Couacilmam Nerriu, to overrule the action of the Planning Commission and instruct the City Attorney to prepare a resolution granting Variance 67-63 subject to conditions in Staff Comments dated 8/14/67.
