The Request for Council Action for this ordinance dated October 20, 2003 <br />and duly signed by the City Manager shall, by this reference be <br />incorporated herein, and together with this ordinance, any amendments or <br />supplementals, and oral testimony constitute the necessary findings for <br />this ordinance. <br /> <br />The City Council has directed that all studies be pursued as expeditiously <br />as is practicable, and has directed staff to expeditiously pursue <br />appropriate revisions to the Code. <br /> <br />The City Council finds, determines and declares that the current and <br />immediate threat to the public health, safety and welfare of the City and its <br />citizens necessitates the immediate enactment of the ordinance. The <br />facts constituting such an urgency are set forth in paragraphs A-J, <br />inclusive of this ordinance. <br /> <br />The City Council further finds that this is a matter of City-wide importance <br />and is not directed towards nor targeted at any particular pamel of <br />property or proposed use. <br /> <br />Section 2. Prohibition <br /> <br />No new Bail Bond use, as a primary use, shall be established, <br />constructed, permitted or expanded in the City of Santa Ana. <br /> <br />No new Bail Bond use, as an ancillary use, shall be established, <br />constructed, permitted or expanded in the City of Santa Ana. <br /> <br />This section shall not apply to any proposed new or expanded Bail Bond <br />Use, which on the date of adoption of this ordinance, has filed a fully <br />complete application with the City for a discretionary permit. This <br />exception i s provided because such discretionary action, if approved b y <br />the City's Planning Commission or City Council, will incorporate conditions <br />of approval which will mitigate the impacts and concerns set forth in <br />Section 1 of this ordinance. <br /> <br />Section 3. Definitions <br /> <br />For purposes of this ordinance, the following terms shall be defined as follows: <br /> <br />"Bail Bond" use shall mean any use or business that is subject to <br />regulation pursuant to California Insurance Code section 1800 et seq., <br />including but not limited to a use or business of a bail agent, a bail <br />permittee or a bail solicitor. <br /> <br />"Primary use" shall mean a use that is not an "ancillary use," as that term <br />is defined in section 41-13.5 of the Code. <br /> <br />Ordinance No. NS-2639 <br /> Page 3 of 5 <br /> <br /> <br />
