ZONING ORDINANCE c~o Hearing was opened on proposed <br />AMENDMENTS amendments to the Zoning Ordinance, <br /> amending the R 3 and R 3 H Districts <br />regarding yard revisions, usable open space requirements, and covered <br />off street parking in the R 3 and R 3 H Districts and revising minimum lot <br />area per dwelling unit in the R 3 H District. There being no response to <br />the call for testimony, the hearing was closed. <br /> <br />On motion of Councilman Griset, seconded by Councilman Herrin and carried, <br />Council approved the proposed Zoning Ordinance amendments and instructed <br />the City Attorney to prepare an ordinance to amend Sections 9230.80 through <br />9230.88, Sections 923(1. 100 through 9230. 108, and Section 9247.4. <br /> <br />CIVIC CENTER STREET ~ % ~'~ Hearing was opened on proposed <br />VACATIONS vacation of streets in the Civic Center <br /> area between Flower and Ross north <br />of 4th Street. Golden Circle D~ive, granted to Hall-Lyon-Mall, Ltd. <br /> <br />Dave Hook, attorney representing Sunset Builders, opposed granting of the <br />variance, read Municipal Code Section 9250.8 and 9250.9 to the Council, <br />and stated the applicant for the variance has failed to meet and fulfill the <br />requirements of the Zoning Ordinance. He also stated this would be spot <br />zoning, would be detrimental to the leasing of his client's property, and <br />deviates from the Master Plan. Gary Taylor, attorney representing the <br />applicant for the variance, stated that the only reason listed on the appeal <br />was that the documents presented by the applicant were not in proper format <br />and that the Assistant City Attorney rendered an opinion at the Planning <br />Commission hearing that the documents were in order. Mr. Taylor expressed <br />the opinion that the church would fit in with the area in the LP zone and that <br />the traffic flow problem has been resolved. Jack Mullen, realtor, displayed <br />sketches of the proposed church. The hearing was closed. <br /> <br />It was moved by Councilman Carlson, seconded by Councilman Brooks, to <br />uphold the action of the Planning Commission and instruct the City Attorney <br />to prepare a resolution granting Variance Application 68-125 subject to <br />conditions in Findings dated January 27, 1969. <br /> <br />The City Attorney stated his opinion that there has been a failure on the part <br /> <br />CITY COUNCIL <br /> <br />131 February 17, 1969 <br /> <br /> <br />
