RESOLUTION NO. 2003-085 <br /> <br />bk: 10/29/03 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA AGREEING TO A PROPERTY TAX <br />TRANSFER WITH THE CITY OF GARDEN GROVE FOR <br />THE 0.632 ACRE PARCEL ON WESTMINSTER AVENUE <br />BETWEEN EUCLID AND NEWFIOPE STREETS TO BE <br />DETACHED FROM THE CITY OF SANTA ANA AND <br />ANNEXED TO THE CITY OF GARDEN GROVE <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br /> Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />The Cortese-Knox Act regulates the change in organization of real <br />property in the State of California, including the detachment of property <br />from one city and its annexation to another. The Orange County Local <br />Agency Formation Commission (LAFCO) is authorized to implement the <br />Cortese-Knox Act. <br /> <br />A request has been received by LAFCO (Application No. RO 03-13) to <br />detach 0.632 acres of property from the City of Santa Ana on Westminster <br />Avenue between Euclid and Newhope Streets and annex that property to <br />the City of Garden Grove. A map showing this property is attached hereto <br />as Exhibit 1 and incorporated herein by this reference. The property is to <br />be used, together with other property already part of Garden Grove, for a <br />self-storage facility in the City of Garden Grove. <br /> <br />Pursuant to the Cortese-Knox Act and California Revenue and Taxation <br />Code section 99 et seq., the Auditor-Controller of the County of Orange <br />has issued a Revenue Impact Analysis report dated October 7, 2003 <br />stating that the annual amount of property tax the City of Santa Ana would <br />lose, and the City of Garden Grove would gain, from this detachment and <br />annexation is $824.85 (in current dollars). <br />After the detachment and annexation, the City of Santa Ana will not be <br />providing public services to this property. Given this fact, and the small <br />amount of property tax at issue, rather than undertake negotiation with the <br />City of Garden Grove regarding how much of these property taxes should <br />be exchanged, the City of Santa Aha is willing to simply accept loss of all <br />such property taxes. <br /> <br /> Section 2. The City of Santa Aha hereby accepts the detachment of the 0.632 <br />acres of property on Westminster Avenue between Euclid and Newhope Streets as <br /> <br />Resolution No. 2003-085 <br /> Page 1 of 4 <br /> <br /> <br />
