RESOLUTION 69-55 RESOLUTION 69~-55 STATING AND <br /> 'DECLARING THE RESULT OF THE <br /> CANVASS OF ELECTION RETURNS <br />OF THE GENERAL MUNICIPAL ELECTION HELD IN THE CITY OF SANTA <br />ANA, CALIFORNIA, ON APRIL 1ST, 1969, was read by title. <br /> <br />It was moved by Councilman Herrin, seconded by Councilman Griset, that <br />further reading be waived and Resolution 69-55 be adopted. On roll call vote: <br /> <br />AYES: Herrin, Brooks, Griset, Markel, Thurman, McMichael <br />NOES: None <br />ABSENT: None <br /> <br />The Clerk of the Council announced that Councilman elect, Ray Villa, had <br />failed to comply with Section 11563 of the Elections Code, which provides that <br />statements of receipts and expenditures shall be filed not later than the day <br />preceding the day upon which the candidate takes office; that Mr. Villa's <br />statement had not been filed until today; that, accordingly, he could neither <br />be sworn into office nor issued his Certificate of Election. <br /> <br />The City Attorney further explained that Mr. Villa could be seated any time <br />after tonight; that another possibility available to the Council was the appoint- <br />ment of Mr. Villa to fill the vacancy on the Council created by the resignation <br />of Mr. James Carlson; that if an elected candidate cannot qualify to be seated, <br />his predecessor will remain on the Council until such time as he may qualify. <br /> <br />Following further discussion, on motion of Councilman Herrin, seconded by <br />Councilman Brooks, Ray Villa was appointed to fill the vacancy created hy the <br />resignation of Councilman Carlson, on the following roll call vote: <br /> <br />AYES: Herrin, Brooks, Griset, Thurman, McMichael <br />NOES: Markel <br />ABSENT: None <br /> <br />The Clerk of the Council administered the oath of office to Ray Villa, replacing <br />Councilman Carlson. <br /> <br />INSTALLATION The Clerk of the Council administered <br /> the Oath of Office to the newly elected <br /> Councilmen, Jerry M. Patterson, Wade <br />Herrin, and Walter Brooks, and thereafter presented Certificates of Election <br />to each. <br /> <br />ADJOURN SINE DIE <br /> <br />On motion of Councilman Herrin, <br />seconded by Councilman Grise~ and <br />carried, the City.
