RESOLUTION NO. 2003-080 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA APPROVING VARIANCE NO. 2003-03 AS <br />CONDITIONED TO ENCROACH INTO THE SIDE YARD <br />AND THE PREVAILING FRONT YARD SETBACK FOR THE <br />PROPERTY LOCATED AT 1811 NORTH HELIOTROPE <br />DRIVE (APPEAL NO. 2003-05) <br /> <br />Koo-11/24/03 <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br /> Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br /> A. The property owner at 1811 North Heliotrope Drive filed Variance No. 2003- <br /> 03 to allow a 3-feet l-inch setback on the southern side yard and a front <br /> yard setback of 37-feet 6-inches. <br /> 1. The original southern side yard was a 3-foot l-inch setback. <br /> Because of termite damage, the property owner was forced to <br /> remove the existing wall and replace the foundation and wall. <br /> Therefore, the property owner is requesting to maintain the historic <br /> southern side yard setback. <br /> <br /> 2. The original structure was set back 41-feet from the front property <br /> line. Because of termite damage, the property owner was forced to <br /> remove the foundation and wall. As part of the redesign of the <br /> structure, a 12-feet 3-inch wide bedroom/office is proposed to <br /> encroach into the required front yard setback. The property owner <br /> is requesting a front yard setback of 37-feet 6-inches setback. The <br /> remainder of the structure will be setback 44-feet 6-inches. <br /> <br /> B. The Planning Commission held a duly noticed public hearing on September <br /> 8, 2003 on Variance No. 2003-03, and approved by a vote of 5:2 (Leo and <br /> Sinclair opposing), to allow the encroachment into the side yard setback of 3 <br /> feet 1 inch and the prevailing front yard setback of 37-feet 6-inches for the <br /> property located at 1811 North Heliotrope Drive. <br /> <br /> C. The City Council of the City of Santa Ana held a duly noticed public hearing <br /> on October 6, 2003, on Appeal No. 2003-05, regarding Variance No. 2003- <br /> 03 to allow the encroachment into the side yard and the prevailing front yard <br /> setback for the property located at 1811 North Heliotrope Drive. <br /> <br /> 1. The public hearing was closed during the October 6, 2003 meeting <br /> and the matter was continued to the November 3, 2003 meeting. <br /> <br /> 2.
