RESOLUTION 2003-100 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA ADOPTING AN AMENDMENT TO THE CITY'S <br />NON-DISPOSAL FACILITY ELEMENT <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines and <br />declares as follows: <br /> <br />A. The California Integrated Waste Management Act of 1989 (Assembly Bill 939) <br />requires cities in California to prepare, adopt, and implement a Source Reduction and <br />Recycling Element (SRRE). A.B. 939 also requires counties to prepare a Countywide <br />Siting Element (CSE). All of these elements are to be included with a Countywide <br />Summary Plan and appropriate environmental documentation into a Countywide <br />Integrated Waste Management Plan (ClWMP). <br /> <br />B. In 1992 the State Legislature passed AB 3001 which amends this Act to require <br />cities and counties to prepare a Non-Disposal Facility Element (NDFE) which requires <br />identification of all solid waste processing facilities other than landfills and refuse <br />incineration facilities within a specific jurisdiction. <br /> <br />C. In 1994 the Santa Ana City Council adopted the City's NDFE which identifies <br />facilities which are used to process and recycling the City's waste as required by AB <br />3001. <br /> <br />D. In 2002, a non-disposal facility known as Madison Materials began operating in <br />the City. This facility is intended primarily for processing construction and demolition <br />debris and other commingled solid waste with a high percentage of recyclable materials. <br /> <br />E. A.B. 3001 requires that a City amend its Non-disposal Facility Element (NDFE) <br />when siting a new non-disposal facility within its jurisdiction that was not previously <br />identified in its NDFE or in the appropriate county's Countywide Siting Element. <br /> <br />F. California Code of Regulations (14 CCR 18766) requires that City's conduct <br />public hearings for the purpose of adopting the SRRE, HHWE, and NDFE. After <br />considering all comments of the members of the governing body and the public, the City <br />shall, by resolution, adopt the SRRE, HHWE and NDFE. <br /> <br />G. On December 1, 2003 the City Council of the City of Santa Ana conducted a duly <br />noticed public hearing on the amendment to NDFE and considered the testimony <br />presented thereat. <br /> <br />Resolution No. 2003-100 <br /> Page 1 of 2 <br /> <br /> <br />
