b. Consultant shall maintain a drug free workplace as set forth in the <br />Certification regarding Drug Free Workplace Requirements, attached hereto as Exhibit <br />E, and incorporated herein by reference. <br />c. Consultant assures and certifies that it will not use any funds appropriated <br />under this agreement for religious activity or anti -religious activity, or to promote or <br />oppose any political candidate, party and/or belief. <br />d. Consultant assures and certifies that where applicable, classroom training <br />instructors are properly credentialed, and training curriculums comply with State <br />Education Codes. <br />e. Consultant assures and certifies that it is in good standing with the California <br />Secretary of State Franchise Tax Board and Internal Revenue Service. <br />f. Consultant agrees to cooperate with any monitoring, inspection, audit, or <br />investigations of activities related to this agreement as may be scheduled and <br />conducted by the Santa Ana WORK Center of the Santa Ana Empowerment <br />Corporation. <br />g. Consultant agrees to acknowledge the Santa Ana WORK Center and Santa <br />Ana Empowerment Corporation as the source of funds in all oral presentations, written <br />documents, publicity and advertisements regarding any activities that ensue from this <br />agreement. <br />11. NOTICE <br />Any notice, tender, demand, delivery, or other communication pursuant to this <br />Agreement shall be in writing and shall be deemed to be properly given if delivered in <br />person or mailed by first class or certified mail, postage prepaid, or sent by telefacsimile <br />or other telegraphic communication in the manner provided in this Section, to the <br />following persons: <br />To City: <br />Clerk of the City Council <br />City of Santa Ana <br />20 Civic Center Plaza (M-30) <br />P.O.
