REQUEST FOR <br />COUNCIL ACTION <br /> <br />CITY COUNCIL MEETING DATE: <br /> <br />JANUARY 5, 2004 <br /> <br />TITLE: <br /> <br />AMENDMENT TO LEGAL SERVICES <br />AGREEMENT WITH KINKLE, <br />RODIGER, & SPRIGGS <br /> <br />RECOMMENDED ACTION <br /> <br />CLERK OF COUNCIL USE ONLY: <br /> <br />APPROVED [] As Recommended <br /> [] As Amended <br /> Ordinance on Is~ Reading <br /> ~ Ordinance on 2nd Reading <br /> [] Implementing Resolution <br /> [] Set Public Hearing For <br /> <br />CONTINUED TO <br /> <br />FILE NUMBER <br /> <br />Direct the City Attorney to prepare and authorize the City Manager and the <br />Clerk of the Council to execute, an amendment to the legal services <br />agreement with Kinkle, Rodiger and Spriggs increasing the hourly rate from <br />$125 to $155. <br /> <br />DISCUSSION <br /> <br />In the past, the law firm of Kinkle, Rodiger and Spriggs has provided <br />legal services to the City and its employees in the specialized area of <br />police-related litigation under the direction of the City Attorney's <br />Office. Funds for this activity are provided through the Liability Fund <br />managed by the Risk Management Division of the Personnel Services Agency. <br /> <br />The City had not assigned this firm any active cases for over two years. <br />Recently, the City Attorney's Office determined that a case required the <br />expertise of this firm and assigned them this case. At that time the City <br />was notified the firm's rates had increased during the three years since <br />the agreement was approved, from the $125 hourly rate to $155 per hour. <br />As this rate remains a highly competitive for firms with the background <br />and expertise of Kinkle, Rodiger and Spriggs, staff recommends approval of <br />the subject amendment to the agreement increasing the hourly rate. <br /> <br />Page 53 25.H. <br /> <br /> <br />
