REQUEST FOR <br /> C:OUNCIL ACTION <br /> <br />CITY COUNCIL MEETING DATE: <br /> <br />CLERK OF COUNCIL USE ONLY: <br /> <br />JANUARY 20, 2004 <br />TITLE: <br />APPROPRIATION ADJUSTMENT <br />~COGNIZING CONDEMNATION <br />FUNDS FOR THE MAIN AND <br />MACARTHUR INTERSECTION - <br />PROJECT 1733 <br /> <br />R£CO M£NDE ACTION <br /> <br />APPROVED [] As Recommended <br /> [] As Amended <br /> [] Ordinance on 1~t Reading <br /> [] Ordinance on 2n~ Reading <br /> [] Implementing Resolution <br /> [] Set Public Hearing For <br /> <br />CONTINUED TO <br /> <br />FILE NUMBER <br /> <br />Approve an appropriation adjustment recognizing funds in the amount of <br />$31,075 in the Measure M Street Construction Fund (account no. 32-01- <br /> 621) and appropriating $31,075 to the Measure M Street Construction Fund <br /> account no. 32-551-6631, project no. 1733) for the Main Street and <br />MacArthur Boulevard intersection project. <br /> <br />DISCUSSION <br /> <br />To accommodate the street widening at the intersection of Main Street and <br />MacArthur Boulevard, acquisition of a portion of the property at 100 West <br />MacArthur Boulevard was required. A good faith offer was made to the <br />property owner in the amount of $31,075, for the purchase of the <br />property. <br /> <br />To meet the project schedule, it was necessary to commence eminent domain <br />proceedings. In February of 2003, the City deposited funds into the <br />State Condemnation Fund for these proceedings. However, staff continued <br />to negotiate with the property owner and was able to successfully <br />complete escrow for this property. The eminent domain proceedings were <br />ceased and the condemnation funds are being refunded to the City. In <br />order to recognize these funds in the current fiscal year, an <br />appropriation adjustment is necessary. <br /> <br />ENVIRONMENTAL IMPACT <br /> <br />In accordance with the California Environmental Quality Act, the proposed <br /> roject has been determined to be adequately evaluated in previously <br /> )ared MacArthur Place Environmental Impact Report 87-01. <br /> <br />Page 17 20.D. <br /> <br /> <br />
