Kdo/1/12/04 <br /> <br />RESOLUTION NO. 2004-004 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA APPROVING CONDITIONAL USE PERMIT <br />NO. 2003-28 FOR A DRIVE-THROUGH WINDOW FOR <br />THE PROPERTY LOCATED AT 3810 SOUTH BRISTOL <br />STREET <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br /> Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />Conditional Use Permit No. 2003-28 came before the City Council of the <br />City of Santa Ana for a public hearing January 5,2004. <br /> <br />Conditional Use Permit No. 2003-28 has been filed with the City of Santa <br />Ana seeking to allow a drive-through window service for the property <br />located at 3810 South Bristol Street. <br /> <br />The Planning Commission of the City of Santa Ana held a duly noticed <br />public hearing on October 27, 2003, and continued the public hearing to <br />November 24, 2003, on Amendment Application No. 2003-08, and <br />Conditional Use Permit No. 2003-28. After conducting the public <br />hearings, the Planning Commission determined that Amendment <br />Application No. 2003-08 is consistent with the General Plan of the City of <br />Santa Ana, and recommended by a vote of 7:0 that the City Council <br />approve Amendment Application No. 2003-08 and Conditional Use Permit <br />No. 2003-28. <br /> <br />Santa Aha Municipal Code Section 41-638 authorizes the City Council to <br />grant a conditional use permit upon making certain findings. <br /> <br />Will the proposed use provide a service or facility which will <br />contribute to the general well being of the neighborhood or the <br />community? <br /> <br />The proposed McDonald's drive-through facility will <br />contribute to the general well being of the area by providing <br />a new restaurant with amenities available to both <br />pedestrians and vehicles traveling along South Bristol Street. <br />Although similar establishments with drive-through window <br />service exist in the immediate vicinity, the drive through <br />establishment will serve to replace an existing sit-down <br />restaurant that will provide additional seating, access, and <br /> <br />Resolution No. 2004-004 <br /> Page 1 of 6 <br /> <br /> <br />
