INS[]RANOE NOT ON FILE A-2003-228 <br />WORK r,'lA¥ PROCEED <br />CLERK OF COUNCIL <br /> DATE: -/4-O¢ SECOND AMENDMENT TO CONSULTANT AGREEMENT <br /> <br /> THIS SECOND AMENDMENT TO CONSULTANT AGREEMENT is entered <br />into on .&t~, "/Crtlt~,~ ] '~' ,2003, by and between the Boys and Girls Club of <br />Santa Aha ("Consultant") and the City of Santa Ana ("City"). <br /> <br />Recitals: <br /> <br />The parties entered into Consultant Agreement #A-2001-197, dated October 1,2001, <br />(hereinafter "said Agreement") by which Consultant has operated a "Power Up" <br />Technology Laboratory as part of the Weed and Seed Site I Special Emphasis <br />Initiative. <br /> <br />B. The parties amended said Agreement to increase compensation available and extend <br /> the term. <br /> <br />C. The parties wish to again increase compensation and extend the term in order to <br /> continue the technology lab. <br /> <br />This program is funded by Weed and Seed grant funds, allocated to City pursuant to <br />Title 1 of the Omnibus Crime Control and Safe Streets Act of 1968, 42 U.S.C. 3701 <br />et. seq. (hereinafter "the Act"). <br /> <br />Wherefore, in consideration of the covenants contained in the Agreement, and subject to <br />all the terms and conditions of the Agreement, except those amended in this Second <br />Amendment to Consultant Agreement, the parties agree as follows: <br /> <br />1. Section 1, SCOPE OF SERVICES, shall be amended to increase services as set forth <br /> in Exhibit A-1, attached hereto and included by this reference. <br /> <br />2. Section 2 a., COMPENSATION, shall be amended to increase the amount available <br /> by $8,000.00. Said section shall read as follows: <br /> <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />the rates and charges identified in Exhibit A. The total sum to be expended under this <br />Agreement shall not exceed $26,000.00 during the term of this Agreement." <br /> <br />3. Section 3, TERM, shall be amended to read as follows: <br /> <br />"This Agreement shall commence on October 1, 2001 and terminate on December 31, <br />2004, unless terminated earlier in accordance with Section 12, below. The term of <br />this Agreement may be extended upon a writing executed by the Executive Director <br />of the Community Development Agency and the City Attorney." <br /> <br />4. A new Section 16 CONSULTANT CERTIFICATIONS, shall be added to read as <br /> follows: <br /> <br /> <br />
