INS[]RANOE NOT ON FILE A-2003-228 WORK r,'lA¥ PROCEED CLERK OF COUNCIL DATE: -/4-O¢ SECOND AMENDMENT TO CONSULTANT AGREEMENT THIS SECOND AMENDMENT TO CONSULTANT AGREEMENT is entered into on .&t~, "/Crtlt~,~ ] '~' ,2003, by and between the Boys and Girls Club of Santa Aha ("Consultant") and the City of Santa Ana ("City"). Recitals: The parties entered into Consultant Agreement #A-2001-197, dated October 1,2001, (hereinafter "said Agreement") by which Consultant has operated a "Power Up" Technology Laboratory as part of the Weed and Seed Site I Special Emphasis Initiative. B. The parties amended said Agreement to increase compensation available and extend the term. C. The parties wish to again increase compensation and extend the term in order to continue the technology lab. This program is funded by Weed and Seed grant funds, allocated to City pursuant to Title 1 of the Omnibus Crime Control and Safe Streets Act of 1968, 42 U.S.C. 3701 et. seq. (hereinafter "the Act"). Wherefore, in consideration of the covenants contained in the Agreement, and subject to all the terms and conditions of the Agreement, except those amended in this Second Amendment to Consultant Agreement, the parties agree as follows: 1. Section 1, SCOPE OF SERVICES, shall be amended to increase services as set forth in Exhibit A-1, attached hereto and included by this reference. 2. Section 2 a., COMPENSATION, shall be amended to increase the amount available by $8,000.00. Said section shall read as follows: "City agrees to pay, and Consultant agrees to accept as total payment for its services, the rates and charges identified in Exhibit A. The total sum to be expended under this Agreement shall not exceed $26,000.00 during the term of this Agreement." 3. Section 3, TERM, shall be amended to read as follows: "This Agreement shall commence on October 1, 2001 and terminate on December 31, 2004, unless terminated earlier in accordance with Section 12, below. The term of this Agreement may be extended upon a writing executed by the Executive Director of the Community Development Agency and the City Attorney." 4. A new Section 16 CONSULTANT CERTIFICATIONS, shall be added to read as follows:
