Occupancy and Contractor's Hours of operation means Customers normal business hours of <br />operation for City staff within Cities facilities. <br /> <br />The Customer will notify Contractor in writing within thirty (30) calendar days of: <br /> <br />Any major changes to energy consuming equipment, operating schedules, business <br />conducted, occupancy, or Contractor's of operation; <br />Any major malfunctions, failures and related changes in energy consuming equipment; <br />Any major damage to, destruction of, or condemnation of the Work. <br />Any Major changes as agreed to by both parties will be used of the Actual Annual <br />Savings in event of dispute. <br /> <br />The Customer upon request of Contractor, will provide copies of requested utility bills within thirty <br />(30) calendar days of request by Contractor. The Customer shall submit said utility bills to Contractor <br />within 30 days of actual receipt of each from utility provider. Said bills may be transmitted in <br />electronic format to an individual as designated by Contract. <br /> <br />Section 6. REMOTE ACCESS. <br /> <br />The Customer will provide remote access, through the Contractor Insight software package or <br />otherwise, subject to reasonable security provisions on Customer's behalf to insure database and <br />operating system integrity, as Contractor reasonably requests. Insight software is the product used for <br />the automation systems controls for buildings and other facilities. The cost for Insight Software is <br />included in the automated systems controls portion of the job scope of this Agreement. The Customer <br />shall receive standard software release/version upgrades of Insight at no cost to the Customer for the <br />entire term of this Agreement. <br /> <br />Section 7. DISPUTE RESOLUTION REGARDNG SAVINGS CALCULATIONS. <br /> <br />Any disputes concerning the calculation of the Annual Energy Savings will be resolved by a third party <br />professional engineering firm acceptable to the Parties. Parties agree to split the cost of said <br />engineering firm, each paying for half the cost. Final resolution of the dispute will be rendered not <br />less than 90 days of selection of firm. <br /> <br /> <br />
