C MANAGER <br /> <br />APPROVED <br /> <br />0 As Recommended <br />0 As Amended <br />0 Ordinance on 1" Reading <br />0 Ordinance on 2nd Reading <br />0 Implementing Resolution <br />0 Set Public Hearing For <br /> <br />CONTINUED TO <br /> <br />FILE NUMBER <br /> <br />RECOMMENDED ACTION <br /> <br />Direct the City Attorney to prepare and authorize the City Manager and <br />Clerk of the Council to execute an agreement with the law firm of Daley <br />and Heft for specialized legal services for the City of Santa Ana. <br /> <br />DISCUSSION <br /> <br />.The City Attorney' s Office provides legal sèrvices to the City, its <br />officials and employees, primarily through staff attorneys. However, it <br />is sometimes necessary to retain outside counsel for specialized fields <br />of practice and cases that have extraordinary staffing requirements. The <br />City is, currently engaged in various extensive projects that require <br />regular and constant eminent domain proceedings. While our staff has <br />handled the majority of the legal proceedings, both the volume and the <br />complexity of the cases now require and merit additional attention that <br />only a firm that specializes in eminent domain can provide. <br /> <br />Daley and Heft has been handling eminent domain cases since 1980 for a <br />variety of public entities throughout California. The scope of services <br />has varied from preparing Resolutions of Necessity, to review of <br />appraisals, to negotiations. Daley and Heft's billing rate is $200 per <br />hour, plus reimbursable costs for expenses such as travel, photocopying <br />and facsimile transmissions. A member of the Litigation Division will <br />supervise counsel to ensure that costs are efficiently reasonably <br />maintained. <br /> <br />In surveying the limited market for these services, City Attorney staff <br />found the rate for the services to be competitive given the complexity of <br />the litigation and expertise possessed by Daley and Heft. <br /> <br />. <br /> <br />25G-1 <br />
