<br />. <br /> <br />. <br /> <br />. <br /> <br />C. <br /> <br />The Facts, Findings and Statement of Overriding Considerations <br />attached to this Resolution as Exhibit "B" and incorporated herein <br />by this reference, with the following amendments recommended by <br />the Planning Commission, which are to be undertaken by the time <br />limits specified for each in the Mitigation Monitoring Plan: <br /> <br />1. <br /> <br />The traffic barriers currently 'located within French Park <br />Neighborhood, as identified in Exhibit "C" attached hereto and <br />incorporated herein by this reference, shall become <br />permanent. <br /> <br />2. <br /> <br />Westbound traffic on Washington Avenue just east of Main <br />Street shall be diverted either north or south at Main Street. <br /> <br />Eastbound traffic on Tenth Street just West of Main Street <br />shall be diverted either north and south at Main Street. <br /> <br />3. <br /> <br />4. <br /> <br />The historic structure located at 1 015 North Broadway shall be <br />relocated to a City approved site and be provided with a <br />permanent foundation and utility service. <br /> <br />5. <br /> <br />The historic structure located at ,11 09 North Broadway shall be <br />relocated to a vacant lot in the City and be rehabilitated, <br />including construction of a permanent foundation and utility <br />service. <br /> <br />6. <br /> <br />Construction of Mitigation Measure No. T-1 shall be limited to <br />a starting time on Saturdays of 8:00 a.m. <br /> <br />D. <br /> <br />The City Council further directs that a Notice of Determination be <br />prepared and filed with the County Clerk of the County of Orange in <br />the manner required by law. <br /> <br />Section 3. Pursuant to Title XIV, Califomia Code of Regulations ("CCR") <br />§ 735,5(c)(1), the City Council has determined that, after considering the record as a <br />whole, there is no evidence that the proposed project will have the potential for any <br />adverse effect on wildlife resources or the ecological habitat upon which wildlife resources <br />depend. The proposed project exists in an urban environment characterized by paved <br />concrete, roadways, surrounding buildings and human activity. Therefore, pursuant to Fish <br />and Game Code § 711.2 and Title XIV, CCR § 735.5, the payment of Fish and Game <br />Department filing fees is not required in conjunction with this project. <br /> <br />Resolution No. 2004-XXX <br />Page4of5 <br /> <br />758-15 <br />
