<br />EIR No. 99-01, AA No. 04-01, <br />GPA No. 04-01, and ZOA No. 04-02 <br />February 23, 2004 <br />Page 5 <br /> <br />on the proposed project. On September 12, 2003, a Planning Commission <br />public hearing was held in order to obtain input regarding the EIR <br />from interested members of the public. By the close of the 45-day <br />review period, 45 written comment letters on the document were <br />received. <br /> <br />The City has evaluated the comments on environmental issues addressed <br />in the comment letters. Each public agency and interested party that <br />commented on the draft EIR were provided with a response to their <br />comments at least 10 days prior to the Planning Commission public <br />hearing. The Responses to Comments document, which was forwarded to <br />the Planning Commission in early February, the Mitigation Monitoring <br />Program (Exhibit 12), and the draft EIR constitutes the Final EIR. In <br />addition, the Findings of Fact and Statement of Overriding <br />Considerations have been included for the project (Exhibit 13). <br /> <br />The EIR identified several unavoidable adverse impacts associated <br />with this project. These impacts pertain to transportation, air <br />quality, utilities and services systems, aesthetics and cultural <br />resources. <br /> <br />Unavoidable transportation impacts include traffic impacts that will <br />reduce the level of service on roads and'intersections to an <br />unacceptable level. Although some intersection improvements are <br />required, other street improvements needed to mitigate the project <br />are infeasible due to the significant land use impacts from the <br />widening. Air quality impacts consist of long-term emissions, <br />particularly nitrogen dioxide (Nox). The project will impact utility <br />and service systems in the area, as it will interfere with broadcast <br />and television signals in the project area. Aesthetics will be <br />adversely impacted as the height, mass and scale of the tower would <br />significantly exceed the height of structures found in the area and <br />would contrast with other nearby buildings. Additionally, the project <br />will create morning shade and shadow impacts in the summer and winter <br />months as well as afternoon shade and shadow impacts. These impacts <br />will be to properties not currently affected by shade from nearby <br />structures. <br /> <br />Finally, cultural resources will be adversely impacted by the project. <br />This project will result in significant adverse impacts associated <br />with the removal of three historic structures and indirect impacts on <br />the setting of the remaining historic structures.
