<br />A-2004-025 <br /> <br />2 <br />3 <br /> <br />INSURANCE NOT REQtJlREC <br />WORK MAY PRomO <br />CLERK OF COUNCIL <br />DATE~ ;;¡-.;..¿j-IY/ <br /> <br />e: fJD. . <br />{j¿ G~ AGREEMENT TO TRANSFER EQUIPMENT <br /> <br />FOR FY 2003 STATE HOMELAND SECURITY GRANT PURPOSES <br /> <br />4 <br />5 <br /> <br />THIS AGREEMENT is entered into this _8th- day of _January- 2004, which date <br />is enumerated for purposes of reference only, by and between the COUNTY OF ORANGE, a political <br /> <br />6 <br />7 <br /> <br />subdivision of the State of California, hereinafter referred to <br />.slhJT/J I}JJ 11 , a _Municipal City <br /> <br />as "COUNTY", <br /> <br />and <br /> <br />8 <br />9 <br /> <br />hereinafter referred to as "SUBGRANTEE." <br />WHEREAS, COUNTY; acting through its Sheriff-Coroner Department in its capacity as the <br /> <br />10 <br />11 <br /> <br />lead agency for the Orange County Operational Area, has applied for, received and accepted a grant <br /> <br /> <br />from the State of California, acting thought its Department of Homeland Security, Office for Domestic <br /> <br />12 <br />13 <br /> <br />Preparedness, to enhance county-wide emergency preparedness, hereinafter referred to as "the grant", as <br /> <br />14 <br />15 <br /> <br />set forth in the grant documents that are attached hereto as Attachment A and incorporated herein by <br /> <br />reference. <br /> <br />16 <br />17 <br /> <br />WHEREAS, the terms of the grant require that COUNTY use certain grant funds to purchase <br />equipment that will be transferred to SUB GRANTEE to be used for grant purposes. <br /> <br />18 <br />19 <br /> <br />NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br /> <br />1. <br /> <br />COUNTY shall transfer to SUBGRANTEE equipment as specified in Attachment B <br /> <br />20 <br />21 <br /> <br />hereto. If COUNTY has not yet acquired any of said equipment, COUNTY shall transfer said <br />equipment to SUBGRANTEE as soon after acquisition by COUNTY as is reasonably practicable. <br /> <br />22 <br />23 <br /> <br />2. <br /> <br />Throughout its useful life, SUBGRANTEE shall use any equipment acquired with grant <br /> <br />funds only for grant purposes. <br /> <br />24 <br />25 <br /> <br />3. <br /> <br />SUBGRANTEE shall exercise due care to preserve and safeguard equipment acquired <br /> <br />with grant funds from damage or destruction and shall provide regular maintenance and such repairs for <br />said equipment as are necessary, in order to keep said equipment continually in good working order. <br /> <br />26 <br />27 <br /> <br />II <br />II <br /> <br />28 <br />
