<br />ARTICLE III <br /> <br />3.0 ATTENDANCE, WORK PERIOD, WORK SCHEDULE & WORKDAY <br /> <br />Attendance. Employees covered by this Agreement shall be in <br />attendance at their work location during hours prescribed by <br />the Police Chief or his designee (s) and shall not absent <br />themselves during prescribed hours without approval of the <br />Police Chief or his designee(s). <br /> <br />3.1 <br /> <br />3.2 <br /> <br />Definitions. <br /> <br />A. <br /> <br />B. <br /> <br />C. <br /> <br />D. <br /> <br />Standard Work Period. The Standard Work Period shall <br />apply to all members of the Association who are not peace <br />officers, detention officers or detention supervisors. <br />The Standard Work Period shall consist of a consecutive <br />seven (7) day, 168 hour period. <br /> <br />Alternative Work Period--207(k) Emplovees. The <br />Alternative Work Period shall apply to all members of the <br />Association who are peace officers, detention officers or <br />detention supervisors who are exempt from the overtime <br />provisions of the Fair Labor Standards Act (FLSA) <br />pursuant to Section 207(k). The 207(k) employees' Work <br />Period shall consist of a consecutive 14 day, 336 hour <br />time period. In conformance with the FLSA, members who <br />are peace officers, detention officers, or detention <br />supervisors shall not be eligible for FLSA overtime, as <br />defined under the FLSA for employees assigned to the <br />Alternate Work Period until they have worked in excess of <br />86 hours in the Alternate Work Period. Nothing in this <br />section shall prevent a peace officer, detention officer <br />or detention supervisor from earning overtime and being <br />compensated for overtime based on the overtime provisions <br />of this Agreement as stated in Article VIII of this <br />Agreement. All such overtime shall be paid at one and <br />one-half (1 1/2) times the regular rate of pay. <br /> <br />Work Hours. Work hours are the regularly scheduled hours <br />of work as determined by the Police Chief or his <br />designee. A "day" is defined as any consecutive 24-hour <br />period. <br /> <br />Work Schedule. At this time, the Police Chief has <br />established the following work schedules. These <br />schedules may be changed by the Police Chief subject to <br />the provisions of the Meyers-Milias-Brown Act. Unless <br />exigent circumstances exist, the Police Chief, or his <br /> <br />4 <br />
