(, ,2004, by and <br />between Motorola, Inc. ("Motorola") and the City of Santa Ana, a charter city and <br />municipal corporation of the State of California ("City"). <br /> <br />RECITALS: <br /> <br />A. The parties entered into Agreement No. A 2002-038, dated April I , 2002, (hereinafter <br />"said Agreement") by which Motorola has provided maintenance and repair service <br />for City's vehicle radio network controller. <br /> <br />B. The parties wish to renew said Agreement for an additional one-year period with the <br />same terms and conditions as described therein. <br /> <br />NOW THEREFORE, in consideration of the mutual and respective promises, and <br />subject to the terms and conditions of said Agreement, the parties agree as follows: <br /> <br />1. Motorola and City agree to renew said Agreement for one year, beginning April 1, <br />2003 and ending March 31,2004. <br /> <br />2. Motorola shall continue to perform those services and accept payment as set forth in <br />said Agreement. The total sum to be expended under this Agreement shall not exceed <br />$33,000,00 during the term ofthis Agreement. <br /> <br />3. Motorola shall maintain and shall require its subcontractors, if any, to maintain <br />professional liability (errors and omissions) insurance, with a combined single limit <br />of not less than $1,000,000 per claim as well as all insurance described in said <br />Agreement. <br /> <br />IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the date <br />and year first written above. <br /> <br />~~'] <br /> <br />PATRICIA E.
