Direct the City Attorney to prepare and authorize the City Manager and <br />Clerk of the Council to execute an amendment to the Contribution <br />Agreement for the purchase and development of Patricia Lane Park. <br /> <br />. Approve an appropriation adjustment reducing the Select Street <br />Construction revenue account (account no. 59-01-5342-5) and the Select <br />Street Construction Improvements Other Than Buildings expenditure <br />account (account no. 59-551-6631) by $94,000. <br /> <br />DISCUSSION <br /> <br />On March 25, 2003, the City approved a Contribution Agreement with the <br />State of California for Transportation Enhancement Activities (TEA) Grant <br />Funding in the amount of $533,000 for the purchase and development of <br />Patricia Lane Park. An appraisal was performed by the Department of <br />Transportation (CalTrans) and the properties were offered to the City at <br />fair market value. <br /> <br />The nine surplus parcels being acquired by the City were originally <br />purchased with Federal, State and OCTA funds for the widening of the I-5 <br />freeway and any revenue received from the sale of the property will be used <br />to reimburse the respective agencies. Because the properties were <br />originally purchased using Federal, State and OCTA funds, the Federal <br />Highway Administration and California Department of Transportation have <br />agreed to waive their portion of the acquisition costs, thereby reducing <br />the required grant funding for this project from $533,000 to $439,000. An <br />acquisition payment will still be required to reimburse OCT A for their <br />~are of the original property acquisition. <br /> <br />25H-1 <br />
