' • • A-2004-017 SECOND AMENDMENT TO FOOD SERVICE AGREEMENT THIS SECOND AMENDMENT TO FOOD SERVICE AGREEMENT is made and entered into this 2nd day of February 2004, by and between the City of Santa Ana, a charter city and municipal corporation of the State of Califomia, ("City") and ARAMARK Correctional Services, Inc., a Delaware corporation ("ARAMARK"). RECITALS: City and ARAMARK entered into Agreement #A2002-007, dated January 22, 2002, ("said Agreement") which grants ARAMARK the exclusive right to provide food service For the inmates, staff and visitors for the Police Administration and Holding Facility located at 60 and 62 Civic Center Plaza, Santa Ana, California. 2. The parties agreed to increase the price per inmate meal, by execution of a First Amendment to Food Service Agreement, dated January 2Q 2003. 3. City and ARAMARK again wish to amend the "Price per meal" in accordance with the terms of said Agreement and to increase the compensation to pay the increased per meal price from February 1, 2004 through January 31, 2005. 4. Additionally, the parties wish to set forth their agreement regarding ARAMARK's use of the facilities to provide food service to other jurisdictions with inmate holding facilities and ARAMARK's provision of inmate food supplies on an as needed basis. WHEREFORE, in consideration of the mutual and respective covenants and promises contained in said Agreement, and subject to all the terms and conditions of said Agreement, City and ARAMARK agree as follows: 1. .Section 1, SCOPE OF SERVICES, shall be amended to include: a. FOOD SERVICE TO OTHER AGENCIES The parties hereby agree that ARAMARK will provide food service to other cities, counties and/or local agencies operating inmate holding facilities, as set forth in Exhibit A-1, attached hereto and incorporated by this reference b. INMATE FOOD SUPPLIES ARAMARK shall, upon request of the Jail Administrator, obtain miscellaneous inmate food supplies, including but not limited to coffee and creamer, as needed by the Jail. ARAMARK agrees that the pricing it offers to the City for such miscellaneous inmate food supplies shall be compazable to available wholesale prices." 2. Exhibit A shall be amended to increase the "price per meal" for inmate meals to $1.879 per meal for the period from February 1, 2004 through January 31, 2005.
