PROCEED <br />CLERK OF COUNCIL <br />DATE: 5 s--vy AMENDMENT TO <br />CONSULTANT AGREEMENT <br />C: PM <br />(f Zern) THIS AMENDMENT TO CONSULTANT AGREEMENT, is entered into this <br />S day of Ka 2004, by and between Science Applications International <br />Corporation / SAI�C, a Delaware corporation ("Consultant") and the City of Santa Ana, a <br />charter city and municipal corporation of the State of California ("City"). <br />Recitals: <br />A. The parties entered into Consultant Agreement No. A-2001-259 dated December 17, <br />2001, (hereinafter "said Agreement') by which Consultant has provided historic <br />property resource identification, evaluation and documentation. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />extend the term of said Agreement for an additional one-year period. <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement the parties agree as follows: <br />1. Section 3, TERM, shall be amended to read as follows: <br />"This Agreement shall commence on December 17, 2001 and terminate on June 30, <br />2005, unless terminated earlier in accordance with Section 12, below. The term of <br />this Agreement may be extended upon a writing executed by the Executive Director <br />of the Planning and Building Agency and the City Attorney." <br />IN WITNESS WHEREOF, the parties hereto have executed this Amendment to <br />Consultant Agreement on the date and year first written above. <br />CITY OF SANTA ANA <br />�� /)f�,,/ <br />STEPHEN G.
