A-2004-034 <br />(T zerM) <br />u[V CNGL ON FILE <br />cnt MAY PROCEED <br />uI IL 114SUI N E EXPIRES <br />i;L€RK OF C UN IL L �M <br />DALE, /riz , �e'/ <br />SECOND AMENDMENT TO <br />CONSULTANT AGREEMENT <br />THIS SECOND AMENDMENT TO CONSULTANT AGREEMENT is entered <br />into this / 5 'day of yi%GI, GKck 2004, by and between Van Dorpe Chou <br />Associates, Inc., a California corporation ("Consultant') and the City of Santa Ana, a <br />charter city and municipal corporation of the State of California ("City"). <br />Recitals: <br />A. The parties entered into Agreement 4N-2003-093, dated September 22, 2003, which <br />was amended by Amendment 4A-2003-213, dated October 6, 2003 (collectively "said <br />Agreement') by which Consultant has provided construction inspection services, <br />including building, mechanical, electrical and plumbing inspections. <br />B. Said Agreement was amended to increase the compensation to pay for additional <br />services during a recruitment period to fill the inspector positions. <br />C. In accordance with the terms and conditions of said Agreement, the parties wish to <br />increase the compensation to continue to provide for temporary inspection services <br />while the City recruits to fill vacant building inspection positions. <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of said Agreement, except those amended in this Second <br />Amendment to Consultant Agreement, the parties agree as follows: <br />Section 2, COMPENSATION, shall be amended to increase the compensation an <br />additional $30,000.00, for a total amount not to exceed $75,000.00 during the term of <br />said Agreement. <br />2. Section 3, TERM, shall be amended to extend the term of said Agreement from <br />January 31, 2004 to June 30, 2004. <br />3. Except as hereinabove modified, all terms and conditions of said Agreement shall <br />remain in full force and effect. <br />
