<br />The Mitigated Negative Declaration and Mitigation Monitoring Program for <br />Environmental Review No. 2003-182, was approved and adopted by <br />resolution which came before the City Council on April 19, 2004. This <br />ordinance incorporates by reference, as though fully set forth herein, this <br />resolution and the Mitigated Negative Declaration and Mitigation Monitoring <br />Program <br /> <br />Section 2. Specific Development No. 71 is hereby amended as set forth in <br />Exhibit "A", attached hereto and incorporated as though fully set forth herein. <br /> <br />D. <br /> <br />Ser.tion 3. <br />entirety. <br /> <br />Section 41-749 of the Santa Ana Municipal Code is hereby repealed in its <br /> <br />Ser.tion 4. This Ordinance shall take effect immediately upon its adoption by <br />the City Council, and the Clerk of the Council shall attest to and certify the vote <br />adopting this Ordinance. <br /> <br />Section 5. If any section, subsection, sentence, clause, phrase or portion of this <br />ordinance is for any reason held to be invalid or unconstitutional by the decision of any <br />court of competent jurisdiction, such decision shall not affect the validity of the remaining <br />portions of this ordinance. The City Council of the City of Santa Ana hereby declares that <br />it would have adopted this ordinance and each section, subsection, sentence, clause, <br />phrase or portion thereof irrespective of the fact that anyone or more sections, <br />subsections, sentences, clauses, phrases, or portions be declared invalid or <br />unconstitutional. <br /> <br />ADOPTED this ~ day of ~, 2004. <br /> <br /> <br />APPROVED AS TO FORM: <br />Joseph W.
