<br />'. <br /> <br />EXHIBIT A <br /> <br />This letter shall serve as an agreement between the City of Santa Ana, CA (hereinafter, <br />CLIENT) and U.S. ADVOCACY (hereinafter, ADVOCATE) whereby ADVOCATE agrees to <br />provide professional lobbying services as directed by CLIENT on issues in the State Legislature <br />and with the Administration. <br /> <br />The tenn of this agreement shall commence March, 2004 and continue through <br />February, 2005. For said services, CLIENT shall pay ADVOCATE a flat fee of $5,000 per <br />month, which will include all travel and miscellaneous expenses. The total sum to be expended <br />under this contract shall not exceed $60,000 during the tenn of the agreement. Either party may <br />tenninate this agreement at any time upon 30 days advance written notice. <br /> <br />It is the intention of the parties to this agreement that the services rendered hereunder and the <br />payments made therefore are not in any way contingent upon the defeat or enactment of any <br />legislative or administrative proposaL The parties hereto agree that such sums as are paid <br />pursuant to this agreement shall be deemed to be the reasonable value of services rendered <br />hereunder. In the event that any agency or court detennines that such payments were otherwise <br />contingent, this agreement shall be deemed rescinded. <br /> <br />All the above requests regarding contingency contracts, fee payments and authorization are in <br />keeping with the requirements ofthe California law as enforced by the Fair Political Practices <br />Commission. <br /> <br />Consultant shall focus its efforts on the following: <br /> <br />I. Assist the CLIENT in pursuing grant funding from the Proposition 40 Parks Acts for <br />parks, cultural institutions, and recreational facilities. <br /> <br />2. Assist the CLIENT in advocating City positions on specific legislation pertaining to: <br />a. Local government financing, i.e. VLF, ERAF proposals <br />b. Redevelopment <br />c. Enterprise zones <br />d. Public safety <br />e. Transportation issues and funding, i.e. Bristol Street Widening <br />f. Worker's Compensation <br />g. Housing <br />h. Issues of local government control and authority <br /> <br />3. Assist CLIENT in working with Administration, state departments, and legislature on <br />issues of interest to the City, specifically: <br />a. 4th District Court of Appeals <br />b. Realigument proposal regarding local government finance <br /> <br />And other matters to be detennined. <br />
