NS-2655 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA ADDING DIVISION 3 OF ARTICLE 2 TO <br />CHAPTER 36 OF THE SANTA ANA MUNICIPAL CODE TO <br />REGULATE VENDING VEHICLES AND AMENDING <br />SECTION 1-18.1 <br /> <br />THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1. Division 3 of Article II is added to Chapter 36 of the Santa Ana <br />Municipal Code to read in full as follows: <br /> <br />DIVISION 3. <br />VENDING VEHICLES <br /> <br />Sec. 36-50. Purpose and Intent. <br /> <br />The city council expressly finds that vending vehicles pose traffic hazards <br />and special dangers to the public safety and welfare of children and <br />residents of the City of Santa Ana. It is the purpose and intent of the city <br />council, in enacting this article, to provide responsible companies and <br />persons who engage in the operation of vending from vehicles with clear <br />and concise regulations to prevent safety and traffic hazards, as well as <br />preserve the peace, safety and welfare of the community. <br /> <br />Sec. 36- 51. Definitions <br /> <br />(a) <br /> <br />"Vending vehicle" shall mean any vehicle, as that term is defined in <br />the California Vehicle Code, which is equipped or used for sale of <br />goods or merchandise, but shall exclude "Ice Cream Trucks" as <br />that term is defined in the California Vehicle Code. <br /> <br />"Goods" or "merchandise" shall include items and products of every <br />kind and description, including all foods, produce, and beverage <br />items except for those goods by an "Ice Cream Truck" as that term <br />is defined in the California Vehicle Code. <br /> <br />"Vend or vending" shall mean soliciting, displaying, offering for sale <br />for monetary or other consideration, or sale, of any goods or <br />merchandise to the public from a vehicle. <br /> <br />(b) <br /> <br />(c) <br /> <br />11 B-1 <br /> <br />Ordinance No. NS-2655 <br />Page 1 of 7 <br />
