<br />One Broadway Plaza <br />Environmental Impact Report <br /> <br />Findings and Facts in Support of Findings <br /> <br />. <br /> <br />Changes or alterations have been required in, or incorporated into, the project which avoid or <br />substantially lessen the significant environmental effect as identified in the EIR. <br /> <br />. <br /> <br />Such changes or alterations are within the responsibility and jurisdiction of another public <br />agency and not the agency making the finding. Such changes have been adopted by such other <br />agency or can and should be adopted by such other agency. <br /> <br />. <br /> <br />Specific economic, legal, social, technological or other considerations, including provision of <br />employment opportunities for highly trained workers, make infeasible the mitigation measures <br />or project alternatives identified in the Final EIR. <br /> <br />2. Based on the Findings stated herein and infonnation contained in the record, it is hereby <br />detennined that: <br /> <br />a. All significant adverse impacts on the environment due to the approval of the project have <br />been eliminated or substantially lessened where feasible. <br /> <br />b. Any remaining significant adverse impacts on the environment found unavoidable are <br />acceptable due to the factors described in the Statement of Overriding Considerations in <br />Section 7.0, above. <br /> <br />10. APPROVALS <br /> <br />The City hereby takes the following actions: <br /> <br />1. The City has certified the Final EIR for the project, as described in Section 1.0, above. <br /> <br />2. The City hereby adopts, incorporates into the project and makes a condition of the project <br />approval, all mitigation measures in the Final EIR, and as discussed in the Findings (Section 2.0, <br />above) and Project Impacts and Disposition of Related Mitigation Measures in the Final EIR <br />(Section 4.0, above). <br /> <br />3. The City hereby adopts the Mitigation Monitoring Program, accompanying the Final EIR and <br />discussed in the Findings (Section 5.0, above). <br /> <br />4. The City hereby adopts the Findings in their entirety, as set forth above, including the Statement <br />of Overriding Considerations. <br /> <br />5. Having certified the Final EIR, independently reviewed and analyzed the Final ErR, <br />incorporated mitigations into the project as conditions of project approval, and adopted the <br />Findings (including the Statement of Overriding Considerations set for herein), the City hereby <br />approves the One Broadway Plaza Project, as described in the Final EIR, including the site <br />approval and design. <br /> <br />U/vfregoso/wp51/reports/One Broadway final findings <br />June 28, 2004 <br /> <br />Page 50 <br />
