<br />Section 308. <br /> <br />Cost of Construction <br /> <br />The cost of developing the Property and of constructing all improvements thereon shall be borne <br />by the Developer, except as otherwise expressly provided in this DDA. Should Developer <br />demolish any structures on the Property, the Agency will credit the actual cost of such <br />demolition (and disposal of demolition waste) ITom the Purchase Price established in Section 401 <br />of this Agreement; provided, however that Developer shall pay "prevailing wage" as that term is <br />defined in the California Labor Code for such demolition. The parties agree and acknowledge <br />that the cost of demolition of structures on the Property would be a cost normally borne by the <br />seller, in this case the Agency, since the Property is being purchased by Developer is valued as <br />"raw land" pursuant to the Report prepared pursuant to Health & Safety Code section 33433, and <br />that in any event such credit, even if it were deemed a subsidy to a private developer, is de <br />minimis in the context of the project. <br /> <br />Section 309. <br /> <br />Commencement and Completion of Construction <br /> <br />The Developer shall begin and complete all the required development within the times <br />specified in the Schedule of Performance, subject to Force Majeure or such reasonable <br />extensions of such times as may be granted in writing by the Agency's Executive Director. <br /> <br />Section 310. <br /> <br />Construction Supervision <br /> <br />Developer shall assure that development on the Property is constructed in accordance <br />with the following requirements: <br /> <br />A. <br /> <br />Developer shall contract with a general contractor, licensed as such by the State of <br />California, for all such construction work. <br /> <br />B. <br /> <br />A project manager of Developer shall inspect the construction work at least once each <br />month until such construction work is complete. A construction progress report shall be <br />prepared by the Developer or general contractor or architect and approved by the <br />Developer and delivered to the Agency's Executive Director at least once each month <br />until such construction work is completed. Such inspection and report shall be limited to <br />the Developer's compliance with this DDA to the extent that the requirements of this <br />DDA exceed, or are in addition to, the normal requirements of the building and zoning <br />codes ofthe City. <br /> <br />C. <br /> <br />Developer shall ensure that construction on the Property complies with all Governmental <br />Requirements. -- <br /> <br />Section 31 I. <br /> <br />Antidiscrimination During Construction <br /> <br />The Developer for itself and its successors and assignees agrees that in the construction <br />of the improvements on the Property provided for in this DDA, the Developer will not <br /> <br />8 <br />
