RECESS <br /> <br />all Council members present. <br /> <br />At 8:55 P.M. , a five-minute <br />recess was declared. Council <br />reconvened at 9:10 P. M., with <br /> <br />POOL PARLOR APPLICATION The application of Robert and <br /> Linda Gustafson for a permit <br /> to operate a pool parlor was <br />considered again. Sgt, Mitchell reported that in checking Police Department <br />records, the staff report reflected five arrests at the location of The Pine <br />Pub in less than a year; these were for intoxication, one for narcotics, and <br />one bottomless arrest in the premises. Mr. Anagnostou, Attorney, stated <br />that with respect to occurrences or arrests made outside of the premises, <br />this is a shopping area wherein there is another night club about four doors <br />down the walkway which uses a mutual parking area. He requested the Council <br />to provide the Gustafson's an opportunity to demonstrate that they are capable <br />of operating this place of business without any interference, infringement or <br />violation by providing them with a proving period, since there has been <br />indication there will be additional evaluation of the Code section; that if the <br />Police Department makes an arrest in these premises, the Council will be <br />advised of it. <br /> <br />Councilman Patterson stated that in view of the fact there have been only five <br />arrests in the past year, and there is no after-hours operation, he would move <br />to approve the application for permit requested by Mr. and Mrs. Gustafson. <br />Councilman Villa seconded the motion, which failed to carry on the following <br />roll call vote: <br /> <br />AYES: Patterson, Villa <br />NOES: Herrin, Griset, Yamamoto, Evans, Markel <br />ABSENT: None <br /> <br />Councilman Herrin stated it was his hope that the Gouncil would provide a <br />reporting procedure through the Police Department that would be in line with <br />the suggestion made by Mr. Anagnostou that if, over a period of time, it is <br />established that The Pine Pub is operated in an acceptable manner, they might <br />be able to make a new appllcation. <br /> <br />Councilman I-Ierrin's motion, seconded by Councilman Evans, to deny the <br />application of Robert and Linda Gustafson for a permit to operate pool parlor <br />in conjunction with The Pine Pub, 2333 W. First Street, carried on the following <br />roll call vote: <br /> <br />AYES: <br />NO ES: <br />ABSENT: <br /> <br />Herrin, Evans, Griset, Yamamoto, Markel <br />Villa, Patterson <br />None <br /> <br />TRAFFIC SIGNAL REFUND Clerk of the Council reported that <br /> she had received a telephone call <br /> from an attorney representing <br />Farmers Underwriters Association in connection with the Council's denial <br />of reimbursement of the signal installation fund at the April 5, 1971, meeting, <br />and that the attorney had requested to be heard at the next regular Council <br />meeting.
