<br />~entative Tract <br />July 12, 2004 <br />Page 1 of 2 <br /> <br />Map No. 2004-02 <br /> <br />Findings of Fact <br /> <br />A. <br /> <br />The proposed project, as conditioned, and its design and <br />improvements are consistent with the Low Density Residential land <br />use designation of the General Plan and are otherwise consistent <br />wi th all other elements of the General Plan and any applicable <br />specific plans. <br /> <br />The proposed subdivision is consistent with the Low Density <br />Residential land use designation and all other elements of the <br />General Plan as well as the North Harbor Specific Plan. <br /> <br />B. <br /> <br />The proposed proj ect, as conditioned, conforms to all applicable <br />requirements of the zoning and subdivision codes as well as other <br />applicable City ordinances. <br /> <br />. <br /> <br />The proposed project, as conditioned, conforms to the <br />provisions of the zoning code with respect to lot size and <br />frontage and setbacks. Covenants, Conditions and Restrictions <br />(CC&Rs) are required for the project, which need to be <br />approved by the City prior to City Council approval of the <br />final map. <br /> <br />C. <br /> <br />The project site is physically suitable for the type and density of <br />the proposed project. <br /> <br />The proposed site is physically suitable for the single-family <br />development as proposed since the property is located within the <br />Single-Family district of the North Harbor Specific Plan (SP2) <br />zoning district and has a General Plan land use designation of <br />Low Density Residential at seven dwelling units per acre (LR7). <br />Additionally, this site is surrounded by the Willowick Golf <br />Course to the east and a combination of single and multi-family <br />residences to the west, north and south. <br /> <br />D. <br /> <br />The design and improvements of the proposed project will not cause <br />substantial environmental damage or substantially and avoidably <br />injure fish and wildlife or their habitat. <br /> <br />. <br /> <br />A Mitigated Negative Declaration was prepared pursuant to the <br />California Environment Quality Act for the project. The <br />project site is located in an urbanized area, and there are no <br /> <br />TTM 04-2 . <br />E~tpAj15 <br />
