APPEAL #307 - (Continued) <br /> <br />There were no further proponents or opponents in the matter, and the Mayor <br />closed the public hearing° <br /> <br />Councilman Markel stated that he would not wish to deter the applicant from <br />rebuilding as requested, and moved that Appeal #307 be granted and Variance <br />Application ~72-49 be approved° Councilman Herrin seconded the motion. <br /> <br />Councilman Patterson stated that if the variance application is approved, there <br />are conditions that would have to apply° <br /> <br />The applicant stated he is requesting that off-street parking be allowed on the <br />lot with the existing residence~ and that the requirement for a wall be waived° <br /> <br />The Assistant Director of Public Works stated that a total of $29, 525 is being <br />paid to the ortner of the property for the value of the improvements and <br />severance damages° <br /> <br />After further discussion, Councilman 1Viarkel offered a substitute motion to <br />grant Appeal #307 and instruct the City Attorney to prepare a resolution <br />approving Variance Application 7Z-49 subject to conditions of approval contained <br />in the Commission report~ except Conditions 6-A and 6-Co The m0iion was <br />seconded by Councilman Herrin and failed to carry on the following roll call vote: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br /> <br />Markel, Herrin; Evans <br />Villa~ Griset, Yamamoto, Patterson <br />None <br /> <br />Councilman Patterson's motion to grant Appeal #307 and instruct the City <br />Attorney to prepare a resolution approving Variance Application 72-49 subject <br />to all conditions of approval contained in the Commission report, was <br />seconded by Councilman Villa. <br /> <br />Mayor Griset stated he was not in favor of the motion because he did not wish <br />to require that the dwelling be removed° <br /> <br />Councilman Herrin's amendment to the motion, seconded by Councilman Evans, <br />to delete Condition 6-A in approving the variance, carried on the following roll <br />call vote: <br /> <br />AYES: Herrin, Evans, Villa, Griset, Yamamoto, Markel <br />NOES: Patterson <br />ABSENT: None <br /> <br />Councilman l~atterson's motion, as amended, carried on the following roll call <br />vote: <br /> <br />AYES: Villa, Evans, Herrin, Griset, Yamamoto, Markel <br />NOES: Patterson <br />ABSENT: None <br /> <br />CITY COUNCIL MINUTES <br /> <br />-29Z- <br /> <br />JULY 17, 1972 <br /> <br /> <br />
