OATH OF OFFICE The Mayor introduced Mr. John <br /> E. Ford who had been appointed to <br />the Personnel Board and the Clerk administered the Oath of Office. <br /> <br />CERTIFICATE OF The Mayor also announced that a <br />APPRECIATION Certificate of Appreciation had <br /> been prepared for Everett Winters <br />who recently resigned from the Personnel Board to accept a vacancy on the <br />Planning Commission and instructed the Clerk to mail it to him. <br /> <br />PRD - AMENDMENT The Mayor opened the public hearing <br />TO MUNICIPAL CODE on the amendment to the Municipal <br /> Code, Additions to Chapter 34 and <br />Chapter 41 - Sec. 34-57 Providing Waiver and Sec. 41-591 Procedures for <br />Waivers, which was initiated and recommended by the Planning Commission and <br />staff. <br /> <br />The Planning Director stated that when the original PRD ordinance was <br />adopted by Council, the ordinance did not include a waiver of the lot size <br />requirement in the subdivision ordinance; and that this ordinance was necessary <br />to implement planned residential development. <br /> <br />There were no opponents or proponents and the Clerk reported no written <br />communications had been received, and the Mayor closed the public hearing. <br /> <br />On motion of Councilman Herrin, seconded by Councilman Yamamoto and <br />unanimously carried, ORDINANCE NS-1124 AMENDING CHAPTER 34 PERTAIN- <br />ING TO SUBDIVISIONS AND ADDING A SECTION TO CHAPTER 41 PERTAINING <br />TO PLANNED RESIDENTIAL DEVELOPMENT was passed to second reading. <br /> <br />VA 72-42 The Mayor stated that this was a <br />MARTIN TREVINO variance application to relocate four <br /> duplexes onto an R 2 parcel containing <br />more than 1/2 acre of land area at 918 North Bewley, and he opened the public <br />hearing. <br /> <br />The Planning Director stated that the Building Code requires relocation of <br />building(s) to be completed within 120 days from the issuance of the building <br />permit; and that a bond to that effect is required to be posted with the City. <br />He further stated that in the case of Mr. Trevino, a time limit was not <br />specifically imposed, but before the buildings can be moved onto the property, <br />the applicant would have to secure building inspection approval, and the 120 <br />day time limit and bonding would also apply to the relocation; and that both <br />the Planning Commission and staff recommend approval of the Variance. <br /> <br />The Clerk reported no written communications had been received on this <br />matter, there were no proponents or opponents in the matter, and the Mayor <br />closed the public hearing. <br /> <br />On motion of Councilman Herrin, seconded by Councilman Yamamoto and <br />unanimously carried, the City Attorney was instructed to prepare a Resolution <br />approving Variance Application 72-42. <br /> <br />CITY COUNCIL MINUTES -316- AUGUST 7, 1972 <br /> <br /> <br />
