CUP 7Z-19 <br />HARVEY BEAR - (Continued) <br /> <br />Prior to voting, the Acting City Attorney advised Council that he had recommended <br />that CUP 72-19 be considered apart from the Consent Calendar because of the <br />recent decision by the California Supreme Court in the case of Friends of Mammoth <br />v. Mono County; and that he recommended to Council that the matter be continued, <br />or in the alternative, that the conditional use permit be received and ordered filed <br />subject to conditions that the developer be required to submit an Environmental <br />Impact Statement that the development would not have more than a trivial impact on <br />the environment and that the developer enter into an agreement with the City holding <br />the C'ity harmless from any.liability on the Conditional Use Permit. He further <br />stated that there were as yet no clear guidelines as to what should be considered <br />"trivial," and recommended to Council that an Environmental Impact <br />Evaluator be appointed to ascertain whether an Environmental Impact Statement <br />should be required of a developer; that if required, the statement would be <br />submitted to the Council for a further finding of fact and that Council would still <br />have the discretion to approve the project even if the environmental impact was <br />found to be more than trivial. <br /> <br />Mrs. lanice Boer, 912 North Lowell, asked Council to not over-react to the Friends <br />of Mammoth case and hire an evaluator, but rather to wait until after the California <br />Legislature r econvenes. <br /> <br />CHRISTMAS DECORATIONS <br />SANTA ANA CITY CENTER <br />ASSOC. & SOUTH MAIN <br />IMPROVEMENT ASSOC. <br /> <br />On motion of Councilman Yamamoto, <br />seconded by Councilman Herrin, and <br />unanimously carried, Council approved <br />the application of SANTA ANA CITY <br />CENTER ASSOCIATION, for Christmas <br /> <br />Decorations on both sides of Fourth Street between Broadway and French, from <br />November 19, 1972 to January 7, 1973, subject to compliance with City safety <br />regulations; and approved Christmas Decorations for the SOUTH MAIN IMPROVE- <br />MENT ASSOCIATION from November 19, 1972 to January 7, 1973, subject to <br />compliance with City safety regulations. <br /> <br />DEEDS, NO CASH On motion of Councilman Evans, <br />GRANTEE, CITY seconded~by Councilman Herrin, <br /> with Councilman Markel voting NO, <br />the Report of No-Cash Deeds accepted by the City Manager, pursuant to Resolution <br />#69-156, from September 28, 1972 through October 11, 1972, inclusive, was <br />received and ordered filed. <br /> <br />CHANGE ORDERS <br /> <br />the following change order was approved: <br /> <br />On motion of Councilman Yamamoto, <br />seconded by Councilman Patterson, <br />with Councilman Markel voting NO, <br /> <br />PROJECT 7013, CITY HALL - Audio visuals for Council Chambers; <br />Change Order ~gO, increasing in the amount of $14,482.34° <br /> <br />CITY COUNCIL MINUTES -397- OCTOBER 16, 1972 <br /> <br /> <br />
