<br />Zoning Ordinance Amendment No. 2004-04 <br />August 9, 2004 <br />Page 3 <br /> <br />of 7: 00 a. m. to 7: 00 p. m. is impractical and would impose an unfair <br />burden on bail bond operations. Therefore, in order to address the <br />compatibility of bail bond uses with other nearby uses, staff is <br />recommending bail bond uses be conditionally permitted in the <br />Professional (P) zoning district. A conditional use permit would allow <br />the city to impose conditions to mitigate any potential negative impacts <br />associated with a bail bond use and/or its 24-hour operation. Similar <br />to those applied to other 24-hour businesses, staff recommends that bail <br />bond uses also be subject to the following standards/conditions: a <br />separation of 150 feet from residential zones; exterior site <br />improvements in compliance with Police Department requirements; <br />prohibi t ion of exterior telephones, outdoor vending machines or other <br />attractive nuisances; posting a sign prohibiting loitering pursuant to <br />Penal Code 602; prohibiting sleeping quarters; and limiting neon <br />displays to signage only. <br /> <br />Due to the particular operational requirements of bail bond <br />establishments, staff recommends that they not be permitted to operate <br />with a Home Occupation Permit. Their need to dispatch from home, hours of <br />operation, installation of silent or audible alarms and other security <br />measures, and the potential for walk-in traffic is incompatible with the <br />intent of a home occupation. <br /> <br />The Planning Division, Police Department and City Attorney's Office have <br />evaluated the concerns raised at City Council meetings. The intent of the <br />proposed ordinance is to locate bail bond uses where they are needed and <br />to mitigate potential negative impacts.
