<br />(JWF 9/03/04) <br /> <br />RESOLUTION NO. 2004-075 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA AUTHORIZING THE CLERK OF THE <br />COUNCIL TO REIMBURSE THE COUNTY OF ORANGE <br />FOR PETITION SIGNATURE VERIFICATION SERVICES <br />RELATED TO THE REFERENDUM PETITION FOR THE <br />ONE BROADWAY PLAZA PROJECT. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br /> <br />A. <br /> <br />On September 1, 2004, referendum petitions were received by the Clerk <br />of the Council, as Elections Official, regarding Ordinance NS-2649 (The <br />One Broadway Plaza project). <br /> <br />B. <br /> <br />On September 1, 2004, the Clerk of the Council determined, prima facie, <br />that the petitions contained 12,718 signatures, which exceeded the 8,475 <br />needed; sufficient for official filing of the petition and requiring formal <br />signature verification by the Orange County Registrar of Voters <br />(Registrar). <br /> <br />C. <br /> <br />Pursuant to Elections Code Sections 9114, the Registrar must complete <br />the verification process within 30 working days following September 1, <br />2004, and may utilize a 500-signature random count process. <br /> <br />D. <br /> <br />The Clerk of the Council, upon advice of the Registrar and in accordance <br />with Elections Code Section 9115, has determined to utilize a 500- <br />signature random verification process. . <br /> <br />E. <br /> <br />The Registrar has estimated the cost of a full count will be approximately <br />$29,000, while a random count will cost approximately $1,700. These <br />costs must be borne by the City. <br /> <br />F. <br /> <br />Under Elections Code Section 9115, the random count must result in a <br />number that is at least 1100/0 of the required valid signatures; otherwise a <br />full count must be conducted.
